R. , Dpty Clerk A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF ZEPHYRHILLS, FLORIDA, APPROVING AND ADOPTING A FINDING OF NECESSITY THEREBY EXPANDING THE CITY'S COMMUNITY REDEVELOPMENT AREA (CRA) TO INCLUDE THE PROPOSED 2015 EXPANSION AREA DIRECTING STAFF TO PREPARE AN ORDINANCE TO INCLUDE THE SUBJECT PARCELS IN THE CITY'S TAX INCREMENT FINANCING (TIF) TRUST FUND DISTRICT, DIRECTING STAFF TO AMEND THE CITY'S COMMUNITY REDEVELOPMENT PLAN TO INCLUDE THE SUBJECT PARCELS AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Florida Legislature duly enacted Chapter 163, Part 111, Florida Statutes (the "Community Redevelopment Act") establishing the conditions and procedures for the establishment or expansion of community redevelopment areas and agencies; and finding that areas or portions thereof which are deteriorating or economically distressed could be revitalized and redeveloped in a manner that will vastly improve the economic and social conditions of the community; and WHEREAS, the City of Zephyrhills held Community Redevelopment Board and City Council meetings on October 23, 2015 to consider the need for expanding the Community Redevelopment Area in the City of Zephyrhills; and WHEREAS,the City of Zephyrhills commissioned Kimley-Horn and Associates, Inc. to prepare an independent finding of necessity analysis of the City; and WHEREAS, the City of Zephyrhills Community Redevelopment Board, following an advertised public workshop meeting reviewed the independent Community Redevelopment Area Finding of Necessity analysis prepared by Kimley-Horn and Associates, Inc. ( a copy of a summary of the findings is attached as Exhibit 'A' attached hereto), considered public input, the recommendation of the staff, and the standards and guidelines of Chapter 163, Part 111, and agreed to proceed with consideration to expand the City's community redevelopment area; and WHEREAS, conditions are present which are detrimental to the sound growth of the City of Zephyrhills Redevelopment Area expansion and which substantially impair or arrest appropriate growth within the area, and present conditions and uses which are detrimental to the public health, safety, morals and public welfare; and WHEREAS, the City of Zephyrhills Community Redevelopment Area Finding of Necessity analysis confirmed that: conditions in the expansion area meet the criteria described in Section 163.340 (7) or (8), blighted areas exist within the Community Redevelopment Area expansion, and the rehabilitation, conservation, or redevelopment of the Community Redevelopment Area expansion is necessary and in the interest of public health, safety, morals or welfare of the residents of the City of Zephyrhills; and WHEREAS, the Community Redevelopment Area expansion is an area that is deteriorating and economically distressed due to outdated building density patterns, inadequate transportation and parking facilities, faulty lot layout and inadequate street layout; and WHEREAS, within the Community Redevelopment Area expansion there is a predominance of defective or inadequate street layout, parking facilities, roadways, drainage facilities, or other public infrastructure; and WHEREAS, aggregate assessed values of real property in the Community Redevelopment Area expansion for ad valorem tax purposes have failed to show any appreciable increase and in fact for some properties within the expansion area such values have declined at rates significantly greater than that of the City of Zephyrhills and Pasco Record and Return to: City Clerk's Office PPULA S.0'NEIL,Ph.D.PPSCO CLERK & COMPTROLLER 5335 8th Street 01/15/2016 11: 14am 14am 1 of 7 Zephyrhills, FL 33542 OR BK 9312 PG 1023 OR BK 9312 PG 1024 2 of 7 County as a whole; and WHEREAS, within the Community Redevelopment Area expansion there exists faulty lot layout in relation to size, adequacy, accessibility, or usefulness; and WHEREAS, within the Community Redevelopment Area expansion there exists unsafe or unsanitary conditions; and WHEREAS, within the Community Redevelopment Area expansion there exists inadequate or outdated building density patterns; and WHEREAS, within the Community Redevelopment Area expansion there exists a substantial commercial vacancy rate; and WHEREAS, the Community Redevelopment Area expansion exhibits a diversity of ownership and unusual property configurations which prevent the free alienability of land; and WHEREAS, within the Community Redevelopment Area expansion there exists a significant degree of nonconformities relative to parking, stormwater management, landscaping, architectural design and community standards; and WHEREAS, the City of Zephyrhills Redevelopment Area expansion can be revitalized and redeveloped in a manner that will vastly improve the economic and social conditions of the community; and WHEREAS, after considering the recommendation of the Community Redevelopment Board and after providing proper notice to all taxing authorities which levy ad valorem taxes on real property in the redevelopment area expansion, and providing the public an opportunity to present testimony and evidence, the City Council, finds as a matter of fact that conditions exist which warrant the expansion of the community redevelopment area. NOW THEREFORE, BE IT RESOLVED BY THE ZEPHYRHILLS CITY COUNCIL,THAT: Section 1. Recitals. The above recitals are true and correct, are hereby accepted as legislative findings of fact, and incorporated into this Resolution by this reference. Section 2. Approval. This Resolution is supported by data and analysis and the City Council makes a legislative finding of fact that the conditions in the City of Zephyrhills Community Redevelopment Area expansion meet the criteria described in Section 163.340 (7) or (8), Florida Statutes. The City Council adopts the Community Redevelopment Area Finding of Necessity summary analysis prepared by Kimley-Horn and Associates, Inc. ("Exhibit A", attached hereto) and in accordance with Section 163.356, Florida Statutes finds that there is a need for expansion of the community redevelopment area for the City of Zephyrhills. The geographic area of the City of Zephyrhills Redevelopment Area with expansion is designated as depicted on the map and legal description attached hereto as "Exhibit B". Section 3. Recordation Required. This Resolution relating to the City of Zephyrhills Community Redevelopment Area expansion shall be recorded in the Minutes of this Board and filed with the City of Zephyrhills City Clerk's Office. Section 4. Effective Date. This Resolution shall take effect immediately upon adoption. Project Overview—From the original district to the 2012 update the focus was 5th Ave and 301 due to DOT and the One-Way Pairs.The expansion looks at the state of residential surrounding the current CRA District. For the downtown and adjacent commercial properties to be profitable the city must encourage more and better residential. Staff reviewed all residential surrounding the current district and narrowed down to the area proposed (Show map)the study area totals approximately 250.4 acres. Data collection included evaluation and field review of the study area, inventory of the planning and physical conditions, including property valuations for the past 5 years also information collected at CRA Workshop, along with Public Input regarding perception of the City. 2. Existing Conditions- (Map)The expansion area: Less than 40%of the residential properties received homestead exemptions...Inadequate and outdated building density patterns, unsanitary or unsafe conditions,faulty lot lay- out in relation to size, adequacy, or accessibility. Uncontrolled access points, lack of parking, poor or non-existing drainage, no curb and gutter were observed in many places or deteriorating curbs and/or street edge. Non-Conformities in relation to approved zoning are evident within area. Stormwater Management- developed properties lack adequate stormwater management facilities and are non-conforming to local and state requirements. Code Violations—Can significantly negatively impact the perception of the area. Illegal signage, unauthorized building additions and conditions, outdoor storage without screening, property maintenance, driveway and parking lot construction. Temporary signage was of particular note. Predominance of defective or inadequate street layout, numerous locations where un-approved parking is occurring or parking facilities are either deteriorating or not maintained altogether. These instances include parking within or on drainage and stormwater conveyance and treatment areas, sidewalk and pedestrian ways, as well as encroachments upon setback or buffer areas. In addition, it was observed where parking facilities appear to be constructed to temporary standards(i.e., gravel, lack of striping, lack of curb)or do not include the necessary(required) landscape buffers between uses or interior parking lot landscaping. In addition, several parking areas were noted as lacking parking lot lighting. 3.
