HomeMy WebLinkAbout702-15 Conditional Use Zephyr Plaza RESOLUTION NO. 702-15 A RESOLUTION RELATING TO ZONING; APPROVING A CONDITIONAL USE TO ALLOW MINI-STORAGE ON PROPERTY ZONED C-2; FINDING CONFORMITY WITH THE COMPREHENSIVE PLAN; PROVIDING AN EFFECTIVE DATE. WHEREAS, an application was filed by Zephyr, LLC for a conditional use to allow a Mini-Storage located on property with the parcel ID Nos. 10-26-21-0020-00000-0030, 10-26-1- 0020-00000-0050; 10-26-21-0020-00000-0100; and 10-26-21-0020-00000-0090; and WHEREAS,the subject property zoning is C-2 (Community Commercial) and Mini- Storage is classified as a conditional use pursuant to the City's zoning ordinance, and consists of approximately 6.25 acres; and WHEREAS,the Site Plan Review Committee recommended approval of the conditional use with the following conditions. a.) The holder of a conditional use permit shall be authorized to utilize the site or location of the use only in the manner specified in the written approval and conditions specified therein. Any substantial expansion, alteration or change in the conditional use authorized by the written approval must be reviewed by the City Council in the same manner in which the original conditional use was reviewed; b.)An expansion, alteration or change of a conditional use shall be deemed to exist where a substantial modification of any of the standards provided for in condition(a) above, results from activity associated with the conditional use or where a substantial change of circumstances or conditions arises; c.) The conditions and stipulations shall become part of the written approval and must be conformed to and followed by the applicant or any successor in interest; d.) The conditional use approval shall run with the ownership of subject property and e.) The owner shall be required to submit a final site plan/related submittals/permits as required for the proposed improvements on the Zephyr Plaza property. NOW THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ZEPHYRHILLS,FLORIDA: Section 1. The foregoing findings are incorporated herein by reference and made a part hereof. Section 2. A mini-storage on property more particularly described as located on property with the parcel ID Nos. 10-26-21-0020-00000-0030, 10-26-1-0020-00000-0050; 10-26-21-0020- 00000-0100; and 10-26-21-0020-00000-0090 is hereby approved. Section 3. The conditional use is approved for the benefit of the applicant only and for the use as specified within the application only, subject to the conditions herein. The character or benefit of this conditional use shall not be changed or transferred without City Council approval by resolution. Section 4. The City Council does hereby expressly find that the provisions of this resolution are in conformity with the Comprehensive Plan of the City of Zephyrhills, as amended. The foregoing Resolution No. 702-15 was read and passed, following a public hearing, in an open and regular meeting of the City Council of the City of Zephyrhills, Florida, on this 27th day of April, 2015.
