fees, must be paid in full. A writtea request from thia office shall
constitute aa official notice to pay additioaal fees.
7. That the owner shall comply with all City, State aad Federal laws ia regard to
social security, workman's compensation, lien laws, etc. , where applicable.
8. That the owaer shall comply with all the safety codea issued by the Florida
Industrial Commission.
9. State law requires constsuctioa to be doae by liceased contractors. You have
applied for a permit uader aa exemption to that law. The exemption allows
you, as the owner of your property, to act as your own coatractor with certaia
restrictioas evem though you do aot have a licease. You must provide direct
oasite supervision of the coastruction yourself. You may build or improve a
one-family or two-family residence or a farm outbuilding. You may also build

Good Morning,
I am sorry for all the confusion you are having to endure.The only request that would be forward to me is a variance I
request for your specific piece of property.That is the request that requires a $500.00 dollar application fee, as we
discussed previously. It is my understanding you do not want to go that route and would like to see the entire section of
the ordinance in regards to accessory building setbacks revised.That is the request that is not within my authority and
requires city council approval.
Below I have provided the answers to your questions.
1. The City of Zephyrhills adopted Ordinance 519 to be known as"The City of Zephyrhills Land Development Code"
February 26th 1990.As to why I do not know that information as it was before my employment, but typically
zoning laws are implemented for aesthetic and safety reasons.
2. R-2 zoning district average lot size is 60 x 140. Meadowood R-2 zoning average lot size is 71 x 110.
3. There have been 11-shed/garage specific,variance request in regards to setbacks.
4. There are specific code requirements for fire separation.Typically In residential construction 10 feet would be
the minimum setback between neighboring structures without fire rated construction.
5. R-2 zoning districts are required to maintain 20 feet front setbacks, 10 feet side setbacks and 10 feet rear
setbacks from property lines.The majority of residential districts in Zephyrhills are required to meet the stated
setbacks.Some Planned Unit Development Subdivisions have 7.5 feet side setbacks.
Additional information that may be helpful is that a shed 90 square feet and under is permissible to have a 5 foot
setback from property line.

like to have some additional information, specifically: �
1. Why was the original ordinance put in place? '
2. What is the average size of a land parcel in town? In Meadowood?
3. How many people have filed variance request with the Board of Adjustment since the ordinance was issued?
4. Does the ordinance have anything to do with fire requirements?
5. What is the average setback for houses located in town? In Meadowood?

' I want to be able to talk intelligently about the existing situation so this information would be very helpful.
Throughout history laws have been changed when they no longer met the purpose they were designed for. It is
my opinion that this ordinance is archaic and no longer meets the needs of the citizens of Zephyrhills. I
understand you do not have the authority to make the change requested and that you are only one person,but '�
you are a very powerful person. I know that you have the best interest of the citizens and the city of Zephyrhills '
at heart. I'm asking you to do what you can to make this change happen. '

I am sorry for what has to be perceived as the run-around, but once again I have no authority to make the change
requested. I work for the city manager and city council. If you have spoken with the city manager you have headed in
the right direction. I know in past e-mails I had requested that you contact the city clerk to have your request heard by
council. At this point the city manager or city council would have to start the ordinance change process.Again I
apologize but I am only in charge of enforcing current ordinance, not amending ordinance. Bill �

When I talked with Mr.Todd Vande Berg several weeks ago he told me I needed to write a letter. I asked to
be put as a speaker on the agenda for the City Council meeting agenda and they told me he was the person I

would need to talk to and that he told me to write a letter. Has the procedure changed? As I stated in the
letter this is not just effecting me. I think the code needs to be changed. I don't feel that as a voting citizen I
should have to pay$500 to ask the Council to reconsider the ordinance. Please advise me my next step.
