HomeMy WebLinkAbout1292-16 MCQUILLEN TRUST REZONING AND FLUMA 1111!11111 11111 IIIII 1111!1111!III!III! 2016052151 ORDINANCE NO. 1292-16 AN ORDINANCE OF THE CITY OF ZEPHYRHILLS, FLORIDA, APPROVING A SMALL SCALE FUTURE LAND USE MAP AMENDMENT TO THE CITY'S COMPREHENSIVE PLAN; CHANGING THE FUTURE LAND USE MAP DESIGNATION FROM COUNTY RES-9 TO CITY RESIDENTIAL SUBURBAN, AND AMENDING THE ZONING FROM COUNTY R1 TO CITY R3, FOR PARCEL 02-26-21-0000-02400- 0000; PROVIDING FOR CODIFICATION, SEVERABILITY, AND AN• EFFECTIVE DATE. WHEREAS, the City Council has been given authority by the State of Florida pursuant to Chapter 163, Florida Statutes, to amend the Future Land Use Map of the City's territori 1 boundaries upon receipt of written consent of the land owners, together with the approval of th City Council of said Future Land Use Map amendment duly expressed by Ordinance; and WHEREAS, the City Council has beengiven authority by the State of Florida pursuant to Chapter 163 and 166, Florida Statutes, to rezone property within the City Limits upon receipt of written consent of the land owner, together with the approval of the City Council of said rezoning duly expressed by Ordinance; and WHEREAS, due public notice of hearing on the proposed rezoning was given by the City Council on March 17, 2016 , as required by the Zephyrhills Land Development Code, as amended, and Chapters 163 and 166, Florida Statutes; and WHEREAS, the Planning Commission, sitting as the Local Planning Agency, did hold a public hearing on the 9th day of February, 2016 to consider said proposed rezoning; and WHEREAS, the Future Land Use Map Amendment meets the criteria of a small-scale Map amendment for the proposed FLUMA amendment are consistent with the goals, objectives and policies of the Comprehensive Plan; and WHEREAS, the City Council has determined that the R3 zoning category would be appropriate would promote the general welfare, and encourage proper development within the City. NOW, THEREFORE, BE IT ENACTED AND ORDAINED BY THE CITY COUNCIL OF ZEPHYRHILLS,FLORIDA, AS FOLLOWS: SECTION 1: The above Whereas clauses are hereby adopted and incorporated herein. SECTION 2: The following described lands, lying and being situated in Pasco County,to wit: Parcel Id No. 02-26-21-0000-02400-0000 Physical Address: 38606 Calumet Avenue - Zephyrhills, FL 33542 Legal Description: BEG 220.00 FT EAST & 155.00 FT NORTH OF SW COR OF NW1/4 OF SEI/4 TH NORTH 180.00 FT TH EAST 65.00 FT TH SOUTH 180.00 FT TH WEST 65.00 FT TO POBNORTH 50 FT RESERVED FOR STREET PER OR 739 PG 212 OR 9156 PG 2514 .40 acres M.O.L. the Future Land Use Map designation Residential Suburban and is hereby rezoned R3 and included within the boundaries of the City of Zephyrhills, Florida. SECTION 3: All ordinances or parts of ordinances in conflict herewith are hereby repealed to the extent of such conflict. 1/ SECTION 4: That if any section, sentence, clause, or phrase of this ordinance is held to b invalid or unconstitutional by a court of competent jurisdiction, then said holding shall in no wa affect the validity of the remaining portions of this ordinance.
