RESOLUTION NO. 720-16
A RESOLUTION RELATING TO ZONING; APPROVING A
CONDITIONAL USE TO ALLOW AN ADULT DAYCARE CENTER ON
PROPERTY ZONED C2, COMMUNITY COMMERCIAL; FINDING
CONFORMITY WITH THE COMPREHENSIVE PLAN; PROVIDING AN
EFFECTIVE DATE.
WHEREAS, an application was filed by Bri Gardens for a conditional use to allow an adult
daycare center on property with the parcel ID No. 02-26-21-0010-03900-0050; and
WHEREAS,the subject property zoning is C2 (Community Commercial) and an adult daycare
center is classified as a conditional use pursuant to the City's zoning ordinance, and consists of 0 0
approximately .07 acres; and

WHEREAS,the Site Plan Review Committee and Planning Commission recommended 6 ®o

approval of the conditional use with the following conditions: ,� N
1. A maximum number of adults being serviced at any one time shall be limited to ten M

2a.) The holder of a conditional use permit shall be authorized to utilize the site or location m
of the use only in the manner specified in the written approval and conditions specified 0
therein. Any substantial expansion, alteration or change in the conditional use authorized by
the written approval must be reviewed by the City Council in the same manner in which the,
original conditional use was reviewed;
2b). An expansion, alteration or change of a conditional use shall be deemed to exist whey
a substantial modification results from activity associated with the conditional use or where a
substantial change or circumstances or conditions arises;

2c). The conditions and stipulations shall become part of the written approval and must be
conformed to and followed by the applicant or any successor in interest; "N

2d). The conditional use approval shall run with the ownership of subject property and; W�

2e). The applicant shall obtain any and all necessary licenses/permits from the State of 3 0
Florida and the building department as well as a commercial business check from the
building department. m

NOW THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF ZEPHYRHILLS,FLORIDA:
Section 1. The foregoing findings are incorporated herein by reference and made a part hereof
Section 2. An adult daycare center on property more particularly described as located on
property with the parcel ID No. 02-26-21-0010-03900-0050 is hereby approved.
Section 3. The conditional use is approved for the benefit of the applicant only and for the use �s
specified within the application only, subject to the conditions herein. The character or benefit
of this conditional use shall not be changed or transferred without City Council approval by
resolution.
Section 4. The City Council does hereby expressly find that the provisions of this resolution are
in conformity with the Comprehensive Plan of the City of Zephyrhills, as amended.
The foregoing Resolution No. 720-16 was read and passed, following a public hearing,in.an open
and regular meeting of the City Council of the City of Zephyrhills, Florida, on this 25th day of
April, 2016.
