which may be more resVictive than County regutations. The undersigned assumes responsibility for compliance with any
appiicabie deed restrictions. I
UNLICENSED CONTRACTORS AND CONTRACTOR RESPONSIBILITIES: If the owner has hired a contractor or
contractors to undertake work,they may be required to be licensed in accordance with state and local regulations. If the
contractor is not licensed as required by law, both the owne�and contractor may be cited for a misdemeanor violation
under state law. If the owner or intended conVactor are uncertain as to what licensing requirements may apply for the
intended work,they are advised to contact the Pasco County�Building Inspection Division—Licensing Section at 727-847-
8009. Furthermore, if the owner has hired a contractor or�contractors, he is advised to have the contractor(s) sign
portions of the"contractor Block"of this application for which they will be responsible. If you, as the owner sign as the
contractor,that may be an indication that he is not properly licensed and is not entitled to permitting privileges in Pasco
County.
TRANSPORTATION IMPACT/UTILITIES IMPACT AND RESOURCE RECOVERY FEES: The undersigned understands
that Transportation Impact Fees and Recourse Recovery Fees may apply to the construction of new buildings, change of
use in existing buildings, or expansion of existing buildings, as specified in Pasco County Ordinance number 89-07 and
90-07, as amended. The undersigned also understands,that such fees, as may be due,will be identified at the time of
permitting. It is further understood that Transportation Impact Fees and Resource Recovery Fees must be paid prior to
receiving a"certificate of occupancy°or final power release. I If the project does not involve a certificate of occupancy or
final power release,the fees must be paid prior to permit issuance. Furthermore, if Pasco County WatedSewer Impact
fees are due,they must be paid prior to permit issuance in accordance with applicable Pasco County ordinances.
CONSTRUCTION LIEN LAW(Chapter 713,Florida Statutes,as amended): If valuation of work is$2,500.00 or more,I
certify that I, the applicant, have been provided with a copy of the "Florida Construction Lien Law—Homeowner's
Protection Guide°prepared by the Florida Department of Agnculture and Consumer Affairs. If the applicant is someone

7.1 The Contract Documents consist of this Agreement with General Conditions,other Conditions or Provisions(sheet 6 of�,

Change Orders(written changes in the Work). The intent of the�Contract Documents is to include all items necessary for

conditions under which the Work is to be performed.
7.4 The Work comprises the completed construction required by the Contract Documents and includes all labor necessary to
produce such construction,and all materials and equipment incorporated or to be incorporated in such construction.
7.5 The term Work applies only to those items included in the Quotat�on Form and not necessarily all items required for completion

ARTICLE 8
ARCHITECT OR ENGINEER
8.1 The Architect or Engineer will provide plans nec:essary for petmitting.
8.2 The Architect or Engineer shall at all times have aocess to the Work wherever it is in preparation and progress.
8.3 The Architect or Engineer will not be required to make exhaustive or continuous on-site inspections to check the quality or
quantity of the Work.
8.4 The Architect or Engineer will not have control or charge of and will not be responsible for construction means,methods,
techniques, sequences or procedures,or for safety precautions and programs in connection with the Work,and he will not
be responsible for the Contracto�s failure to carry out the Work in accordance with the Contract Documents.

ARTICLE 9
OWNER

9.3 If the Contractor fails to correct Defective Work or persistently fai�s to carry out the Work in accordance with the Contract
Documents,the Owner,by a written order,may order the Contractor to stop the Work,or any portion thereof,until the cause
for such order has been eliminated;however,this right of the Owner to Stop the Work shall not give rise to any duty on the part
of the Owner to exerase this right for the benefit of the Contrado�.
ARTICLE 10
CONTRACTOR ,
10.1 The Contractor shall supervise and direct the Work, using his best skill and attention and he shall be solely responsible for all
construction means,methods,techniques,sequences and procedures and for coordinating all portions of the Work under the
Contract(exclusive of any items by Others or by Owner or not speafically included in Quotation Form).
102 The Contractor shall provide and pay for all labor,materials,equipment,tools,construction equipment and machinery necessary
for completion of all items induding as Contractor's responsibilify in Quotation Form.
10.3 The Contractor shall at all times enforce strict discipline and good order among his employees and shall not employ on the Work
any unfit person or anyone not skilled in the task assigned to him.
90.4 The Contractor warrants to the Owner that all materials and equipment incorporated in the Work will be new unless otherwise
specified,and that all Work will be of good quality,free from faults and defects and in conformance with the Contract Documents.
All Work not conforming to these requirements may be considered defective.
10.5 Unless otherwise provided in the Contract Documents,the Contractor shall pay all sales,consumer,use and other similar taxes
which are legally enacted at the date of the Contract Documents�.
10.6 The Contractor shall secure and pay for the building permit and fi r all other permits and govemmental fees included in the
Quotation Fortn.
10.7 The Contractor shall give all notices and comply with all laws,ordinances,rules,regulations,and lawful orders of any public
authority bearing on the performance of the Work. I
10.8 The Contractor shall be responsible to the Owner for the acts and omissions of his employees,sub-contractors and their agents
��, and employees,and other persons performing any of the Work under a contract with the Contracfor.
r. ,� The Contractor shall review,approve and submit to the Owner all,Plans and Shop Drawings,Product Data and Samples required
� by the Contract Documents. The Work shall be in acoordance with approved submittals.
10.10The Contractor shall keep the premises free from accumulation of waste materials or rubbish caused by his operations. At the
completion of the Work(included in the Quotation Form)he shall remove all his waste materials and rubbish from the Project as
well as his tools,construction equipment,machinery and surplus�materials.
10.11The Contractor shall pay all royatti�s and license fees. He shall defend�all suits or claims for infingement of any patent rights and
shall sa�e the Owner harmless from loss on account thereof.
90.12To the fullest extent permitted by law,the Contractor shall indem�ify and hold harmless the Owner against claims,damages,
losses and expenses,including but not limited to attomey's fees arising out of or resulting ftom the performance of the Work
provided that any such claim,damage,loss or expense(1)is attnbutable to bodily injury,sickness,disease or death,or to injury
to or destruction of tangible property(other that the Work itselfl including the loss of use resulting therefore,and(2)is caused
in whole or in part by any negligent ac#or omission of the Contractor,and Subcontractor,anyone diredly or indirectly employed
by any of them or anyone for whose acts any of them may be liable,regardless of whether or not it is caused in part by a party
indemnified tiereunder. Such ob1'igation shall not be construed to negate,abridge,or otherwise reduce any other right or
obligation of indemnity which would otherwise exist as to any party or person described in this Paragraph in any and all claims
against the Owner by any employer of the Contractor,any Subcontractor,anyone di�ectly or indirectly employed by any of them
or anyone for whose acts any of them may be liable,the indemnification obligation under this Paragraph shall not be limited in
any way by any limitation of the amount or type of damages,compensation or benefits payable by or for the Contractor or any
Subcontractor under worker's ar workman's compensation acts,disability benefit acts or other employee benefit acts.
ARTICLE�11
SUBCONTRAC'T`ORS
11.1 A Subcontractor is a person or entity who has a direct contracf wit�h the Contractor to perForm any of the Work at the site.
11.2 The Contractor shall not employ any Subcontractor to whom the Owner may have a reasonable objection. The Contractor
shall not be required to contract with anyone to whom he has reasonable objections. Contracts between the Contractor and
the Subcontractors sh�ll(1)require each Subcontractor,to the extent of the Work to be pertormed by the Subcontractor,to
be bound to the Contractor by the terms of the Contract Documents,and to assume toward the Contractor all the obligations
and responsibilities which the Contractor,by these Documents,assumes toward the Owner and(2)allow to the Subcontractor

' WORK BY OWNER OR BY SEPARATE CONTRACTORS
'12.1 The Owner reserves the right to perform work related to the Project with his own forces,and to award Separate Contractors in
connection with other portions of the Project or other work on the site. If the Contractor claims that delay or additional cost
is involved because of such action of the Owner,he shall make such daim in the form of a Change Order to the Owner.
12.2 The Contractor shall afford the Owner and Separate Contractoi's reasonable opportunity for the introdu�tion and storage of
their materials and equipment and the execution of their work,and shall connect and coordinate his Work with theirs as
required by the Contract Documents.
12.3 Any costs caused by defective or ill timed work shall be bome by the party responsible therefore.

ARTICLE 73
MISCELLANEOUS PROVISIONS
13.1 The Contract shall be govemed by the law of the pface where the Project is located.
93.2 In all daims or disputes between the Contractor and the Owne�arising out of,or relating to,the Contract Documents or the
breach thereof,the legal fees are to be bome by the party in breach of cflntract.
13.3 If a dispute between the Contractor and the Owner arising out of,or relating to,the Contract Documents or breach thereof,
is decided by an Arbitration Assoaation,the awarded rendered by the arbitrators shall be final and judgment may be entered
upon it in accordance with applicable law in any court having jSrisdiction thereof.
ARTICLE 14
TIME
14.1 All Time limits stated in the Contract Documents are of the ess i nce of the Contract. The Contractor shall expedite the Work
and achieve substantial oompletion within the Contract Time.
14.2 The Date of Substan6a1 Completion of the Work is the Date of Approval by the building department for the items covered under
the Contract Documents(only items included in Quotation Form).
14.3 If the Contractor is delayed at any time in the progress of the Work by changes ordered in the Work,by labor disputes,fire,
unusual delay in transportation,delays caused by govemmental agencies,adverse weather conditions,unavoidable casualties,
���� or any�causes beyond the Contractor's control,then the Contract Time shall be extended for a reasonable time.
•, ARTICLE 15 1
� PAYMENTS AND COMPLETION
15.1 Payments shall be made as provided in Artide 4 and Article 5 of the Agreement.
15.2 Payments may be withheld on acxount of(1)defective work not�remedied,(2)claims filed,(3)failure of the Contractor to make
-- payments properly to Subcontraotors or for labor, materials,or equipment, (4)damage to the Owner or another contractor,or
(5)persistent failure to carry out the Work in acc:ordance with the Contract Documents.
' 15.3 Final payment shall not be due until the Contractor has deliveretl to the Owner a complete release of all liens arising out of the
Contract or receipts in full covering all labor,materials and equipment for which a lien could be filed. If any lien remains un-
satisfied after all payments are made,the Contractor shall refund to the Owner all monies the latter may be compelled to pay in
discharging such lien,including all costs and reasonable attorney's fees.
15.4 The making of final payments shall constitute a waiver of all claims by the Owner except those arising from(1)unsettled liens,
(2)faulty or defecfive Work appearing after Substantial Completion,(3)failure of the Work to comply with the requirements of
the Contract Documents,or(4)terms of any special warranties�equired by the Contract Documents. The acceptance of final
payment shall constitute a waiver of all claims by the Contraetor�except those previously made in writing and identified by the
Contractor as unsettled at the time of the final Appliption for Payment.
ARTICLE 16
PROTECTION OF PER NS AND PROPERTY
16.1 The Contractor shall be responsible for ini6ating, maintaining,and supervision all safety precautions and programs in connection

17.1 Contractor's liability insurance shail be purchased and maintaine�d by the Contractor to protect him from claims under workers
compensation acts and other employee benefrt acEs,ctaims for damages because of bodily injury,including death,and from
claims for damages,other than to the Work itsetf,to property wliich may arise out of or result from fhe Contractor's operations
under this Contract,whether such operations be by himself or by an Subcontractar or anyone directly or indirectly employed
by any of them. Certificafes af insurance shalt be fited with the Owner prior#a the Cornr►�encetner�t af the Woric.
17.2 The Owner shall be respansible far purchasing and maintaining his own liability insuranr,�e and,at his option,may maintain
such insurance as wil!protect him against claims which may anse frarri operatians under the Contrac#.
97.3 The Owner shal)purchase and mairrtain properfy insutance upon the entire Work at the site to the futl insurable vatue thereof,
(Builders Risk). This insurance shall include the interests of thelOwner,the Contractor and Subcontractor in the Work and shall
ir�sure agaSnst the perils of fire and extended coverage and shatl include"a11 risk"insurance far physical#oss ar damage including,
without duplication of coverage,theft,vandalism and malicious mischief.
17.4 Any loss insured under Paragraph 17.3 is to be adjus#ed with the Owner and made payable to the Owner as ttustee for the
insured,as#heir interests may appear,subject to the requirements of any mortgagee ctause.
17.5 The Owner shall file a capy of all policies with the Contractor before an exposure to loss may occur.
17.6 Tha t�wner and the Gontractor waive al!rights against eact=othei�for damages caused by fire ar other perils to the ex#ent covered
by insurance obtained pursuant to this Article or any other property insvrance applicable fo the Work,excepf such rights as they
may have#o the proceeds of such insurance held by#he Owner as trustee. The Contractor shall require similar waivers in favor
af the Owner and the Cantracfor by Subcontractars.
ARTICLE 18
CHAI�GES IN THE tNORK
18.1 The Owner,without invalidating the Contract,may order Changes in the Work aansisting of additions,deletians and modifications,
the Con#ract Sum and the Cor�#ract Time being adjusted accordingty. All such changes in the Work shaU be authorized by
Change Order between the Owner and fhe Canfractor.
18.2 Any changes required by engineering,the building department or any other govemmental agency are to be paid by#he Owner
upon receipt af an invoice�rorn the Contractor.
18.3 The Contract Sum and the Contract Tirne may be changed by CF�ange Order.

notice to the Owt�er terminate the Contract and recover fro the Owner payment for all Work executed and for any proven loss
sustained upon any materials,�equipment,tools,and constructio�equipment and rr�achinery,inc�uding reasonable prafit and
damages applicable to the Project.
20.2 If the Contractor defaults or persistenUy#ails or neglects to carry out the Work in accordance with the Contract Documents ar
fai#s to perfarm any provisions of the Contract,the dwner may,after sever(7}days wriften notice to the Cantrac#ar and without
prejudice to any other remedy he may have,make gaod such deficiencies and may deduct the cost thereof,from the payment
then or#t�ereafter due the Contractor ar,at his optian,and may#erminate#he Contract and#ake possession of the site and of
aN materials,equipment,toats,construcfion equipment and maci��inery therean awned by the Gontractar and may finish the Work
by whatever method he may deem expedient,and if the unpaid balance af the Contract Sum exceeds the e�ense of finishing
