Subcontractor is to fumish all necessary equipment,labor and materials to properly complete their scope of work within the specified schedule and such items are deemed included in the bid price. W.4RR�.(VTY: The Subcontractor warrants to the Owner, Client, and Contractor that materials and equipment fumished under this Subcontract will be of good quality and new unless required or permitted by the Subcontract documents,that the work of the Subcontractor will be free from defects not inherent in the qualiry required or permitted and that the work will conform to the requirements of the Su6contract documents and meet or exceed building standards. Work not conforming to these requirements,including subsfifutions not properly authorized,will be considered defective. Subcontractor agrees to provide a one('I)year warranty from the date Contractor receives final inspection or achieves Substantial Completion. Subcontractor agrees to respond to a request for warranty work within twenty-four(24)hours after receivirig a request and promptly correct the problem within five(5)working days,at Subcontractors expense. GENERAL PROilISIOPIS: The Contractor may, at�any time,provide the Subcontractor with a written Notice to Subcontractor,indicating the nature of any problem(s}and providing the Subcontractor with a stated response time. Failure'to respond within the stated period will be considered a Breach of this Agreement and the Contractor may take whatever steps deemed necessary to keep the project on schedule,including but not limited to, suspending payments, replacing the Subcontractor and 8ack Charging all expenses including cost overruns. Subcontractor is responsible for any damages caused by Subcontractor's work force and by Subcontractor's suppliers or materials.The use of drugs or alcohol is strictly prohibited on or near any job site and will be grounds for immediate dismissal. Waste materials, boxes and similar materials are to be placed in dumpster or where directed by Superintendent. Subconiractor is responsible for keeping any debris away from adjoining properties. Contractor may back cha�ge the Subcontractor for clean-up work performed on their behalf at the rate of$65 per hou'r plus disposal fees.
