This conuact may be amended only by written instrument signed by Owner and Conhactor.
2.All work sball be completed in a worlananship like manner and in compliance with all building codes and other applicable laws.In the event that state,county or municipal codes or
regulations require work not expressly set forth in this Contmct,and/or differing materially from that genernlly recognized as inherent in work of the character provided for in this Contract,as a
condition for approval by such authority,any extra cost for Conhactor's labor and materials shall be the sole obligation of the Owner.Contrector shall notify Owner immediately upon leaming
of such requirements.
3.This Contract shall be construed and the relationship of the parties detemilned 'm accordance with the]aws of the State of Florida including specifically Chapter 713.Florida Statues.
Mechanics Lien Iaw,and in particulaz,Chapter 713.05,Florida Statutes,which provides that Contractor shall t�ave a lien on the real pmperty improved by the work for any money that is owed
Contractor for labor,services,materials,or other items required by,or fiunished in accordance with this Conhact.
4.Should concealed or unknown conditions am an existing skuchse be at variance with conditions indicated in the description of the work to be performed,or should concealed or�own
conditions in an existing swchue of an unusual nature,differing materially from those ordinarily encountered and genenlly cecognized as inherent work of the chazacter provided for in this
Contract,be encountered,the Contract price shall be equitably adjusted upon notice thereof from the Contractor to the Owner.
5.IN NO EVENT,WfiETHER OCCASIONED BY A BREACH�'WARRANTY CONTAINED IN THIS AGREEMENT,OR BY ANY OTI-IER CAUSE,WHETI-IER BASED UPON,OR
SOUNDING IN,CONTRACT,TORT,NEGLIGENCE,STRICT LIABILITY,WILLFUL AND WANTON CONDUCT,WARRANTY(EXPRESSED OR IMPLIED),OR OT HERWISE
ARISING OUT OF,OR RELATING TO,TFIE W ORK AND SERVICES PERFORMED UNDER THIS AGREEMENT,OR OTHERWISE SHALL CONTRACTOR BE LIABLE FOR OR
OBLIGATED IN ANY MANNER FOR SPECIAL CONSEQUENTIAL,OR INDIRECT DAMAGES,INCLUDING BY WAY OF EXAMPLE BUT NOT BY WAY OF LIMITATION,
SUCH DAMAGES AS,DAMAGE TO INTERIOR,IASS OF USE,LOSS OF PROFITS,OR SUTTS BY THIItD PARTIES.WARRANTIES ARE ONLY FOR CUSTOMER SPECIFIED

6.Conuactor shall not be respons�ble for or liable for any damages to Owner if the Contrac[or is delayed at any time in the progress of tt�e work by any act of neglect of Owner,or by any
sepazate contrnctor employed by the Owner,or by the changes ordered by Owner in the work, or by labor disputes,fire, unusual delay in transportation,adverse weather conditions,
unavoidable casualties,or any causes beyond the Contractois connol,or by delay authorized by the Owner.
7.Any controversy or claim arising out of or relating to this contract,or the breach thereof,shall be settled by arbitration administered by tbe American Arbitration Association under iu
Construction Indushy Arbitretion Rules,and judgment on the award rendered by the azbitrntor(s)may be entered in any co¢rthaving jurisdiction thereof.
8.Paymenu due and unpaid under the Contract shall beaz interest from the date payment is due at the rate of 18%per annum.If the Owner does not pay the Contrector the payments specified
under this Conhact,the Contcactor may stop work until payment of the amount owing has been received.In such event,the contract price shall be increased by the amoimt of the Contractor's
reasonable costs of sbutdown,delay,and start-up.
9.It shall be the sole obligation and responsibility of the Owner to determine the existence of any resuictions contained in deeds,subdivision or neighborhood rules and regulations which
might relate to or restrict the improvements contemplated by this Contract.Contractor shall have no]iabiliry or responsbility for any such nonconformity to or with such restrictions or
requ'uements.Contractor shall be entitled to payment&om Owner of all sums due hereunder nnhvitt�standing any injunction or prolubition against the work as a result of any violation of such
restriction or requirements.
10.Due to the nature of tbe construction to be done at homeowners request,the Owner takes sole responsibility of any damage done to the driveway at job location.
I1.All agreements contingent upon strikes,accidents or delays beyond our control.Owner to carry fire,tomado and other necessary insucance.All guarantees/warianties can/will be voided if
any water penetration enters from outside the work area as described in contract.
12. Contrector not responsible for any a'u condition damage or malfunctions. Reasonable caze will be taken in handling the air conditioning equipment.
