AN EMERGENCY ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF ZEPHYRHILLS, FLORIDA, PROVIDING FOR CRITICAL
EMERGENCY MEASURES IN RESTRICTING WATER USE AND
CURTAILING NONESSENTIAL USES OF WATER; PROVIDING FOR
SEVERABILITY; PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City of Zephyrhills is responsible for providing water service to t e
citizens of Zephyrhills, Florida and portions of unincorporated Pasco County; and
-WHEREAS,the Southwest Florida Water Management District(hereinafter referred to s
the "District" has imposed new water restrictions calling for Phase IV limits on water usage aid
Pasco County falls under those restrictions; and
WHEREAS, the City of Zephyrhills does not fall under the water restrictions imposed b
the District; and
WHEREAS, the combination of continuing drought conditions creating the existence f
local water supply shortage conditions makes it imperative and necessary that certain uses f
water be restricted or curtailed and that available water resources be conserved in order to prote c t
the health, safety and general welfare of the citizens of the City of Zephyrhills; and
WHEREAS, the City Council of the City of Zephyrhills, upon recommendation of staff, found
that without the imposition of the following measures, the public 1 ealth and safety of the citizens
of Zephyrhills and all of the customers of the City's water system is threatened and all such uses
are facing an impending acute local water supply shortage, so it is in the best interest of all users
of water from the City's system to severely limit the use of Water for lawn and landscape
irrigation and other non-essential uses to protect the ability to continue to serve its customers.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY O
ZEPHYRHILLS, FLORIDA:

This ordinance is adopted in accordance with and pursuant to the authority of Chapt r
166 of the Florida Statutes.
SECTION 2. EMERGENCY WAIVER OF NOTICE
It is hereby declared that the public's need for adoption of this ordinance is so immediate
and urgent as to constitute an emergency. This ordinance shall take effect in accordance with the
emergency ordinance provisions of Section 166.041 of the Florida Statutes. Notice as otherwise
required by the Florida Statutes is hereby waived by a two-thirds 0/3 vote of the membership of
the City Council declaring that an emergency exists and that the immediate enactment of this
ordinance is necessary.
SECTION 3. CITY WATER RESTRICTIONS
The water restrictions placed upon Pasco County by the Southwest Florida Water Management
District shall be applicable within the city limits of the City of Zephyrhills, Florida.
SECTION 4. SEVERABILITY
If any part of this ordinance shall be held invalid by a corn of competent jurisdiction, th
remaining parts shall be severable and shall continue to be in full force and effect.
SECTION 5. EFFECTIVE DATE
This ordinance shall take effect on the 1St day of May, 2009.
