AN ORDINANCE OF THE CITY OF ZEPHYRHILLS, FLORIDA,
REPEALING ORD. A-15; PROVIDING FOR SALE AND SERVICE OF
ALCOHOLIC BEVERAGES BY; PROVIDING FOR SEVERABILITY
AND AN EFFECTIVE DATE.
WHEREAS, the City of Zephyrhills desires to create a level playing field for busine s
located within the municipal limits of the City; and
WHEREAS, the City has been notified that unincorporated Pasco County current�y
permits the sale of alcoholic beverages by Licensees on Sunday beginning at 11:00 a.m., whi e
the City currently only permits sales beginning at 1:00 p.m., thus placing local business at a
disadvantage; and
WHEREAS, the City desires to aid and encourage the City's economic vitality and the
growth and success of businesses within the City and provide the City's citizens that choose o
obtain alcoholic beverages beginning at 11:00 a.m. each day of the week with the opportunity o
do so within their own City;
WHEREAS, the City believes that given unincorporated Pasco County's permitting f
responsible consumption and purchase of alcohol beginning at 11:00 a.m. each day of the wee :,
the City's prohibition concerning sales and service of alcohol on Sundays before 1:00 p. .
directs business away from the City to Licensees and venues located in enclaves and adj ace it
jurisdictions; and
WHEREAS, the City may adjust the times for the service and sale of alcohol pursuant o
Section 562.14, Fla. Stat.
BE IT ORDAINED BY THE CITY OF ZEPHYRHILLS, FLORIDA:
SECTION 1: HOURS OF SALE.
A. No alcoholic beverages shall be sold, consumed, served or permitted to be served Qr
consumed in any place holding a state license between the hours of 2:00 a.m. and
7:00 a.m. of the same morning, except as provided in this section.
B. B. No alcoholic beverages shall be sold, consumed, served or permitted to be sere d
or consumed in any place holding a state license between the hours of 2:00 a.m. a d
11:00 a.m. of each Sunday.
SECTION 2: INCONSISTENCY.
A. If any Ordinances or parts of Ordinances are in conflict herewith, this Ordinance
shall control to the extent of the conflict.
SECTION 3: SEVERABILITY.
A. If any portion of this Ordinance is determined to be void, unconstitutional, r
invalid by a court of competent jurisdiction, the remainder of this Ordinance sha 1
remain in full force and effect.

regular meeting of the "City Council of the City of Zephyrhills, Florida, on this 14th day f
September,2009.
