AN EMERGENCY ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF ZEPHYRHILLS, FLORIDA, PROVIDING FOR CRITICAL
EMERGENCY MEASURES IN RESTRICTING WATER USE AND m
CURTAILING NONESSENTIAL USES OF WATER; PROVIDING FOR o
SEVERABILITY; PROVIDING FOR AN EFFECTIVE DATE. OOr-

WHEREAS, the City of Zephyrhills is responsible for providing water service to the citizens o �a
Zephyrhills, Florida and portions of unincorporated Pasco County; and o
WHEREAS, the Southwest Florida Water Management District as-th "'

"District" has imposed new water restrictions calling for Phase IV limits on water usage and ( .)
Pasco County falls under those restrictions; and N

WHEREAS, the City of Zephyrhills does not fall under the water restrictions imposed by the A
District; and
WHEREAS, the combination of continuing drought conditions creating the existence of local
water supply shortage conditions makes it imperative and necessary that certain uses of water be
restricted or curtailed and that available water resources be conserved in order to protect th
health, safety and general welfare of the citizens of the City of Zephyrhills; and
WHEREAS; the City Council of the City of Zephyrhills, upon recommendation of staff, foun
that without the imposition of the following measures, the public health and safety of the citizen
of Zephyrhills and all of the customers of the City's water system is threatened and all such user
are facing an impending acute local water supply shortage, so it is in the best interest of all user
of water from the City's system to severely limit the use of water for lawn and landscap
irrigation and other non-essential uses to protect the ability to continue to serve its customers.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY -O
ZEPHYRHILLS, FLORIDA:
SECTION 1. ENACTMENT AND AUTHORITY
This ordinance is adopted in accordance with and pursuant to the authority of Chapte
166 of the Florida Statutes.
SECTION 2. EMERGENCY WAIVER OF NOTICE
• It is hereby declared that the public's need for adoption of this ordinance is so immediate
and urgent as to constitute an emergency. This ordinance shall take effect in accordance with the
emergency ordinance provisions of Section 166.041 of the Florida Statutes. Notice as otherwise
required by the Florida Statutes is hereby waived by a two-thirds (2/3 vote of the membership o
the City Council declaring that an emergency exists and that the immediate enactment of this
ordinance is necessary.
SECTION 3. CITY WATER RESTRICTIONS
The City of Zephyrhills shall follow the water restrictions adopted by Pasco County.
SECTION 4. SEVERABILITY
If any part of this ordinance shall be held invalid by a court of competent jurisdiction, the
remaining parts shall be severable and shall continue to be in'full force and effect.
• SECTION 5. EFFECTIVE DATE
This ordinance shall take effect September 27, 2010 upon passage on the second reading and
signing by the Mayor.
