Garcia, Dpty Clerk AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF ZEPHYRHILLS, FLORIDA CREATING REGULATIONS AND REQUIREMENTS FOR. THE INSPECTIONS AND MAINTENANCE OF PRIVATELY OWNED FIRE HYDRANTS; PROVIDING FOR INSPECTION AND MAINTENANCE FORMS; PROVIDING FOR SEVERABILITY AND AN EFFECTIVE DATE: WHEREAS, Section 633.025(3)Florida Statutes states the Life Safety Code adopted by the Sta e Fire Marshal, shall be deemed to be adopted by each municipality, county, and special distri t with fire safety responsibilities as part of the minimum fire(safety code; and WHEREAS, the City of Zephyrhills, City Council adopted the current editions of the Flori a Fire Prevention Code (NFPA 1 and NFPA 101); and WHEREAS, the City of Zephyrhills, City Council desires to provide for additional requireme t for the inspection of privately owned fire hydrants; and WHEREAS,NFPA 1 of the Florida Fire Prevention Code, Section 1.12.1, provides that the Ci y of Zephyrhills shall be authorized to establish and issue permits pertaining to condition , operations, or materials.hazardous to life or property; and WHEREAS, NFPA 1 of the Florida Fire Prevention Code, Chapter'13, Fire Protection System ; provides that the City of Zephyrhills shall have the authority to require that documents for all fire protection systems be submitted for review and approval and a permit be issued for prior o installation,, rehabilitation, or modification. Furthermore, Ch. 13 permits the City of Zephyrhil s to have the authority to require acceptance tests of the systems performed in the presence of t e City's(Authority Having Jurisdiction)AHJ. Short Title 07/2 2 /l i PG 1421 This ordinance shall be known as the Private Fire Hydrant Ordinance. SECTION 2. Referenced Codes Unless it is clear from the context that another meaning'i intended, the following words, wh n used in this Ordinance shall have the meanings attributed to them by this section. NFPA 1 —Uniformed Fire Code NFPA 24—Standard for"Installation of Private Fire Service Mains and Their Appurtenances" NFPA 25 — Standard for "Inspection, Testing, and Maintenance of Water-Based Fire Protection Systems" NFPA 101 -Life Safety Code SECTION 3. Definitions AHJ — Authority having jurisdiction. The City's AHJ would be the Zephyrhills Fire Rescue designee or Zephyrhills Utilities Department designee. Private Fire Hydrant—A valved connection on a water supply system having one or more outlets and that is used to supply hose and fire department pumpers with water. Private Fire Service Main—Private fire service main, is a�pipe and-its appurtenances on priva e property (1),between a source of water and the, base of the system riser for water-based f e protection. systems, (2) between a source of water and thl base elbow of private hydrants, (') beginning at the inlet side of the check valve on a gravity olr pressure tank. Purpose All fl re hydrants within the city limits of Zephyrhills which are not maintained by Zephyrhills City Utilities .(Water Department) or Zephyrhills Fire Rescue shall be installed and maintained annually per NFPA 24 and inspected annually pursuant to the requirements of NFPA 25. Such inspections and maintenance shall be performed by a certified licensed contractor for private fire service mains and their appurtenances. The Licensed Contractor installing private Fire Hydrants shall coordinate with the City of Zephyrhills Utilities Department for assignment of hydrant numbers to the newly installed hydrants. The identification numbers shall be affixed to the hydrant by the Contractor and maintained on the inspection form, hydrant tag and hydrant by the Contractor. The property owner or franchisee shall cause to be completed annually an inspection and maintenance form, as may be adopted by the City from time to time. Such form shall be forwarded to the Zephyrhills Fire Rescue Fire Marshal's Office within thirty (30) days upon completion of the inspection. SECTION 5. Repair When a deficiency is found upon an annual inspection, which requires a repair to be made, it shall be noted on the inspection and maintenance form. Major deficiencies that require a private fire service main and/or their appurtenances to be shut down,.repaired or replaced will require 24 hours prior notification of the Zephyrhills Fire Marshal's Office. A permit shall be obtained from the City of Zephyrhills by a certified contractor that can correct the deficiency. Depending on the scope of the work to be completed to correct the deficiency, it may be necessary to submit plans and supporting documentation to obtain this permit. The Fire Marshall shall determine whether plans and supporting documentation are required to obtain a permit. SECTION 6. Approval When a correction to a deficiency has been made,, which required a permit; a final inspection shall be completed by the Zephyrhills Fire Marshal's Office. The inspection will ensure the work was properly completed and the private fire service main and/or their appurtenances have been returned to normal operating service. SECTION 7. Penalty Failure to comply with the provisions set forth in this Ordinance shall be grounds to assess penalties as outlined in the City of Zephyrhills Resolution: Fire User Fees (currently 603-08) and its subsequent revisions. Failure to comply with the requirements of the City of Zephyrhills may result in service interruptions or daily penalty fees. SECTION 8. Severability If any section, subsection, sentence, clause or provision of this Ordinance shall be declared invalid, the remainder of this Ordinance shall be construed as not having contained said section, subsection, sentence, clause or provision, and shall not be affected by such holding. SECTION 9. Effective Date Certified copies of this,Ordinance shall be filed with the Department of State by the Clerk of the City of Zephyrhills, Florida, within ten (10) days after adoption by the City Council of Zephyrhills and shall take effect upon filing.
