CITY ZONING C-3 (GENERAL COMMERCIAL), IN ACCORDANCE (0
WITH PROVISIONS OF SECTION 166.041, FLORIDA STATUTES;
PROVIDING FOR CODIFICATION, CONFL CT, SEVERABILITY, AND
AN EFFECTIVE DATE.
WHEREAS, James and Lila Crandell, the owners of 1 d hereinafter described in Section-2
below, did petition on the 23rd day of March, 2011 for rezoning of said land; and
WHEREAS, the City Council has been given:authority by the State of Florida pursuant' to
Chapter 163, Florida Statutes, to amend the Future Land Use Maps of_the City's territq :al
boundaries upon receipt of written consent of the land owners, together with"the'apprji al of tie:-
City Council of said Future Land Use Map amendment dul expressed'.by;Ordinance_ rid J
WHEREAS, the City Council has been given authont by the State Q ,Florida pursuar t. o
Chapter 163 and 166, Florida Statutes, to rezone property within the City t- its 'ppn;r ipt of
written consent of the land owner, together with the approval of the Cityottucil of sad
rezoning duly expressed-by Ordinance; and
WHEREAS, due public notice of hearing on the prop sed rezonu �vvas?given lI,the Ci
Council on August 11, 2011,.as required by.-the Zep yrhills Lai Development Code, LS
amended, and Chapters 163 and 166,Florida Statutes; and
WHEREAS, the Planning Commission, sitting as the Locil Planning=Agency;_di -hold a gub c
hearing on the 12th day of July, 2011 to consider said prop sed rezoning;and :
WHEREAS, the Future Land Use Map Amendment mi ets the criteria° rss -scale M p
amendment for the proposed FLUMA amendment in appl cation of James and'Lira Crandell e
consistent with the goals, objectives and policies of the Co riprehensive Plan; and
WHEREAS, the City Council has determined that the C-2 (General Commercial) zoni g
category would be appropriate, would promote the ge Leral-welfare, and encourage prop r
development within the City.
NOW, THEREFORE, BE IT ENACETED AND ORDANIED BY THE CITY C OUNCI L
OF-ZEPHYRILLS,FLORIDA,AS FOLLOWS: .
SECTION 1: The above Whereas clauses are hereby adoj ted and incorporated herein.
SECTION 2: The following described lands, lying and befg situated in Pasco County,to wit:
Legal Description: Tract 81 in Section 23, Township 2 South, Range 21 East, Zephyrhi s
Colony Company Lands, as per plat thereof recorded in P1 it Book 1, Page 55, Public Records f
Pasco County, Florida, less portion included in State Roa right-of-way, as to Tract 96, and that
part of Tract 82, lying east of State Road 39. In Section 2 , Township 26 South, Range 21 Ea t,
Zephyrhills Colony Company Lands, according to map or plat thereof recorded in Plat Book ,
Page 55, Public Records of Pasco County, Florida.

the Future Land.Use Map designation MU (Mixed Use) and is hereby rezoned C-2 (General
Commercial) and included within the boundaries of the City of Zephyrhills; Florida subject to
the following conditions:
1. Applicant shall obtain a City occupational license
2. Applicant shall secure a fire department review of the property
3. Future development/redevelopment shall require the submittal of a site plan that
complies with City ordinances and regulations and Pasco County right-of-way preservation map
SECTION 3: All ordinances or parts of ordinances in conflict herewith are hereby repealed to
the extent of such conflict.
SECTION 4: That. if any section, sentence, clause, or phrase of this ordinance is held to be
invalid or unconstitutional by a court of competent jurisdiction, then said holding shall in no way
affect the.validity of the remaining portions of this ordinance.
SECTION 5: This ordinance shall take effect as provided in the City Charter and Chapter 163,
Florida Statutes.
