AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
ZEPHYRHILLS, FLORIDA, APPROVING A ARGE SCALE FUTURE
LAND USE MAP AMENDMENT TO THE CITY'S COMPREHENSIVE
PLAN; CHANGING THE FUTURE LAND USE MAP DESIGNATION
FOR THE TERRITORY HEREINAFTER DESCRIBED FROM COUNTY
FUTURE LAND USE MAP DESIGNATION IL (LIGHT INDUSTRIAL)
TO CITY FUTURE LAND USE MAP DESIGNATION CITY PSP (PUBLIC N
SEMI-PUBLIC), CONSISTENT WITH THE GOALS, OBJECTIVES, AND
POLICIES OF THE ADOPTED COMPREHENSIVE PLAN, AS �, m
REQUIRED BY THE GROWTH MANAGEMENT ACT OF 1985;
AMENDING_THE ZEPHYRHILLS -LAND DEVELOPMENT_:CODE_ TO
CHANGE THE ZONING ON LAND HEREINAFTER DESCRIBED FROM I; ' a
COUNTY ZONING CATEGORY COUNTY AC (AGRICULTURAL I
CONSERVATION) TO CITY ZONING AP-1 (AIRPORT), IN a r
ACCORDANCE WITH PROVISIONS OF SE�TION 166.041, FLORIDA
STATUTES; PROVIDING FOR CODI ICATION, CONFLICT,
SEVERABILITY,AND AN EFFECTIVE DATE. fl
WHEREAS, the City of Zephyrhills, the owner of land hereinafter described in Section 2 below
did petition on the 17th day of August, 2011 for rezoning of said land; and
WHEREAS, the City Council has been given authority by the State of Florida pursuant t
Chapter 163, Florida Statutes, to amend the Future Land Use Map of the City's territoria
boundaries upon receipt of written consent of the land ownIrs, together with.the approval of th
City Council of said Future Land Use Map amendment duly expressed by Ordinance; and
WHEREAS, the City Council has been given authority t,y the,oState of Florida pursuant to
Chapter 163.3184, Florida Statutes to conduct an expedited State.review process for'adoption o
a Comprehensive Plan Amendment; and t '
WHEREAS, the City Council has been given authority by the State of Florida pursuant to
Chapter 1.63 and 166, Florida Statutes, to rezone property within the City Limits upon receipt o
written consent of the land owner, together with the approval: of the City Council of said
rezoning duly expressed by Ordinance; and
WHEREAS, due public hearing notice on the proposed Notice of Transmittal to the
Department of Economic Opportunity was given by the City Council;on-October 1:, 2011, as
required by the Zephyrhills Land Development Code, as amended, and Chapters 163 and 166,
Florida Statutes; and
WHEREAS, due public notice of hearing on the proposed rezoning was given by the City
Council on December 8, 2011, as required by the Zephyrhills Land Development Code, as
amended, and Chapters 163 and 166, Florida Statutes; and
WHEREAS, the Planning Commission, sitting as the Local Planning Agency, did hold a public
hearing on the.8th day of September, 2011 to consider said Future Land Use Pam amendment and
the proposed rezoning; and
WHEREAS, the Future Land Use Map Amendment meets the criteria of a large-scale Map
amendment for the proposed FLUMA amendment in application of the City of-,Zephyrhills are
consistent with the goals, objectives and policies of the Comprehensive Plan; and

WHEREAS, the City Council has determined that the AP-1 (Airport) zoning category would be
appropriate, would promote the general welfare, and encourage proper.development within the
City.
NOW, THEREFORE, BE IT ENACTED AND ORDAINED BY.THE CITY COUNCIL
OF ZEPHYRILLS,FLORIDA,AS FOLLOWS:
SECTION 1: The above Whereas clauses are hereby adopted and incorporated herein.

SECTION 2: The following described lands, lying and being situated in Pasco County, to wit:
Parcel I.D. No. 19-26-22-0000-00400-0020
Legal Description: Commence at the Northwest corner of Section 19, Township 26 South, Range
22 East, Pasco County for a point of beginning; Thence S89°44'34"E along the North boundary
of the Northwest 1/4, of Section 19, 525.58', Thence S33°01'00"E 98667' to a point of
curvature of a curve to the right, said curve having a radius of 400.00', chord of 107.20', and
chord bearing of S25°18'56"E, Thence along the arc of said curve 107.53',. Thence
N89°44'29"W 1113.21', to the West boundary of the Northwest 1/4 of said Section 19, Thence
N00°15'31"E along said boundary 921.59' to the point of beginning.

(Airport) and included within the boundaries of the City of Zephyrhills, Florida.
SECTION 3: All ordinances or parts of ordinances in conflict herewith are hereby repealed to
the extent of such conflict.
SECTION 4: That if any section, sentence, clause, or phrase of this ordinance is held to be
invalid or unconstitutional by a court of competent jurisdiction,then said holding shall in no way
affect the validity of the remaining portions of this ordinance.
SECTION 5: This ordinance shall take effect as provided in the City Charter and Chapter 163,
Florida Statutes.
