Bonilla, Dpty Clerk AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ZEPHYRHILLS, FLORIDA, AMENDING THE ZEPHYRHILLS LAND / • DEVELOPMENT CODE TO CHANGE THE ZONING ON LAND HEREINAFTER DESCRIBED FROM CITY ZONING CATEGORY C2 (COMMUNITY COMMERCIAL) TO CITY ZONING CATEGORY TMU (TRADITIONAL MIXED USE), IN ACCORDANCE WITH PROVISIONS OF SECTION 166.041, FLORIDA STATUTES; PROVIDING FOR CODIFICATION, CONFLICT, SEVERABILITY, AND AN EFFECTIVE DATE. WHEREAS, the Donna McLeod,-the owner of land hereinafter described-in Section 2-:belo did petition on the 25th day of August, 2011 for rezoning of said land; and Ip�P WHEREAS, the City Council has been given authority by the State of Florida pursuant to Chapter 163 and 166, Florida Statutes, to rezone property within the City Limits upon receipt of written consent of the land owner, together with the approval of the City Council of sai OD rezoning duly expressed by Ordinance; and •' ii WHEREAS, due public notice of hearing on the proposed rezoning was given by the Cit `tea Council on November 3, 2011, as required by the Zephyrhills Land Development Code, a s~' amended, and Chapters 163 and 166, Florida Statutes; and o, WHEREAS, the Planning Commission, sitting as the Local Planning Agency, did hold a public hearing on the 11th day of October, 2011 to consider the proposed rezoning; and 0 WHEREAS, the City Council has determined that the TMU (Traditional Mixed Use) zonin category would be appropriate, would promote the general welfare, and encourage prope development within the City. NOW, THEREFORE, BE IT ENACTED AND ORDAINED BY THE CITY COUNCI OF ZEPHYRHILLS,FLORIDA,AS FOLLOWS: SECTION U 'The above Whereas clauses are hereby adopted and incorporated herein. SECTION 2: The following described lands, lying and being situated in Pasco County, to wit: Parcel I.D. No. 11-26-21-0010-10000-0080 and 11-26-21-0010-10000-0130 Legal Description: City of Zephyrhills PB1 PG54 Lots 8=�2 incl and Lot 7 less N15 FT Bloc 100 OR 8590.PG 420 and City of Zephyrhills PBI PG54 Lots 13-16 incl Block 100 OR 8590 PG 420 is hereby rezoned TMU(Traditional Mixed Use) SECTION 3: All ordinances or parts of ordinances in conflict herewith are hereby repealed t the extent of such conflict. SECTION 4: That if any section, sentence, clause, or phrase of this ordinance is held to b invalid or unconstitutional by a court of competent jurisdiction, then said holding shall in no wa affect the validity of the remaining portions of this ordinance. SECTION 5: This ordinance shall take effect as provided in the City Charter and Chapter 16 , Florida Statutes.
