ORDINANCE NO. 1080-12
AN ORDINANCE OF -THE CITY COUNCIL OF THE CITY OF
ZEPHYRHILLS, FLORIDA ESTABLISHING A 12 MONTH
MORATORIUM ON RECEIVING AND PROCESSING PERMIT
APPLICATIONS FOR INTERNET CAFES AND ON INTERNET
SWEEPSTAKES CAFES; PROVIDING FO SEVERABILITY; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, Internet Sweepstakes Cafes are a new type of business that is currently n t
addressed in the City of Zephyrhills Land Development Code and the Code of Ordinances; and
WHEREAS, some communities have had difficulty with these businesses, especially since
their codes did not take into consideration all the effect they may have on surrounding properti s
both commercial and residential; and
WHEREAS, the City does not currently have an application for such businesses, but anticipate
this new business may choose to locate here in the near future; and
WHEREAS, the City Council desires to establish a moratorium for a period of 12 months o
that a study can be done to determine the effects this type of business would have on other
adjacent land uses in the City.
WHEREAS, City Council desires to pass this emerge cy ordinance to protect the gene ial
welfare of our businesses and residents by allowing the city to study and adequately amend t ie
City Code to address internet cafes and internet sweepstake cafes.
NOW THEREFORE BE IT ORDAINED THAT:
SECTION 1. There is hereby a 12 month moratorium on receiving and processing applicatio is
for building permits, conditional use permits, zoning permits and any other permit under the City
of Zephyrhills Land Development Code or the City of Zephyrhills Code of Ordinances regardi g
the establishment, development or expansion of internet cafes or sweepstake internet cafes.
SECTION 2. City Staff is hereby directed to conduct research and study the impacts of inten et
cafes and internet sweepstake cafes on neighboring land uses and the community at large so tl at
appropriate revisions to the Land Development Code and/or the City Code of Ordinances may e
recommended by staff and adopted by City Council.
SEVERABILITY: It is declared to be the intent of the City Council of the City f
Zephyrhills, Florida, that if any section, subsection, sentence, clause, or provision of t is
Ordinance shall be declared invalid, the remainder of this Ordinance shall be construed as not
having contained said section, subsection, sentence, clause or provision and shall not be affected
by such holding.
This Ordinance shall take effect upon passage by the City Council and signing by the Mayor.
The foregoing Ordinance No.1080-12 was read and passed as an emergency Ordinance in
open and regular meeting of the City Council of the C' of Zephyrhills, Florida, on this 26 d y
of'March, 2012.
