Garcia, Dpt Clerk AN ORDINANCE OF THE CITY COUNCIL OF THE CITY,- OF ZEPHYRHILLS, FLORIDA ANNEXING ADDITIONAL TERRITORY TO BE INCLUDED WITHIN THE BOUNDARIES OF 'SAID CITY DESCRIBED AS PARCEL 35-25-21-0010-06500-0040 LOCATED AT 38928 PRETTY POND ROAD, ZEPHYRHILLS, FLORIDA, IN ACCORDANCE WITH SECTION 171.044,FLORIDA STATUTES,AS AMENDED. . i WHEREAS, Robert and Dolores Martin have consented to the annexation, by the City o Zephyrhills of the lands herein described in Section 1 below by executing an Agreement Arisin Out of Request for City Services Outside Corporate Limits; and WHEREAS, the City is authorized by Chapter 171, Florida Statutes, to annex contiguous an infill areas, and to extend the City limits upon receipt of written consent of the land owner together with the approval of the City Council after notice and public hearing; and WHEREAS, the City Council has reviewed and evaluated the application submitted and ha determined that the annexation of said lands into the City is in the-public interest and i consistent with the City's Comprehensive Plan and Land Development Regulations. 4, NOW THEREFORE, BE IT ENACTED, AND ORDAINED BY THE CITY COUNCI, OF THE CITY OF ZEPHYRHILLS,FLORIDA,AS FOLLOWS: SECTION 1: The following described lands, lying and being situated in Pasco County,to wit: PAULA S.0'NEIL,Ph.D.PASC0 CLERK & CO PTRR Parcel I.D. No. 35 25 21 0010 06500 0040 04/26/12 R BK : PG of 1 8 4 Legal Description: Tract 65, of ZEPHYRHILLS COLONY COMPANY LANDS as per pla thereof recorded in PB 1 PG 55 of the Public Records of Pasco County, Florida, being furthe described as: Begin at the NE corner of the SE 1/4 thence West.156.85 feet; thence South 2° 54 W, 15.02 feet for a Point of Beginning; thence continue South 2° 54W, 132.13 feet; thence N 89 16' 07" w, 143.37 feet; thence N 0° 22' 40" E, 130.13 feet; thence East 149.18 feet to the Poi of Beginning; excluding the North 15 feet for road right-of-way .39 acres m.o.l. and the adjacent right-of-way of Pretty Pond Road from the easterly most point westwar through the intersection of Wire Road the same are hereby annexed to and included within the boundaries of the City of Zephyrhill Florida, a municipal corporation. SECTION 2: Said lands are contiguous to or are infill of the present City limits of the City o Zephyrhills. That said lands are now unincorporated and lie in the same County as said City, an when annexed would form a compact addition to the incorporated territory of said City. Th owners of said lands contained in said area to be annexed have given written consent to hay such annexation for said area. SECTION 3: The City of Zephyrhills, Florida is authorized by the legislature of the State o Florida, pursuant to Section 177.044, Florida Statutes, and pursuant to the Charter of the City o Zephyrhills, to annex contiguous and infill areas and to extend the City limits or territorial boundaries upon receipt of a written consent of all owners of land contained in the area to b annexed, together with the approval of the City Council of the City of Zephyrhills, of sai annexation duly expressed by Ordinance. SECTION 4: It is the intention of the City Council of the City of Zephyrhills, Florida to anne the above-described lands to said City within its territorial limits and the boundary lines of sai City are hereby redefined and extended so as to include said area of land within its territorial limits upon the final passage of this Ordinance.
