AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
ZEPHYRHILLS, AMENDING SECTION 6 OF ORDINANCE NO. 1003-08;
PROVIDING FOR SEVERABILITY AND AN EFFECTIVE DATE. çc
WHEREAS, the City Council of the City of Zephyrhills, Florida has,previously found
and determined it to be in the best interest of the safety, health, and welfare c the citizens of the��y
City of Zephyrhills to establish, police, fire, parks and recreation, and trari ' ortation and othe
impact fees to require new development to pay their equitable share of public impro emefj th t 16
must be constructed to serve new growth; and
WHEREAS, pursuant to Section. 6 of Ordinance No. 1003-08, Term a 4-Review.,�rh
City Council has conducted a full evaluation of the components of the transportation iin�p`act fee;
And.
WHEREAS, the City has retained Kimley-Horn and Associates, Inc. (Kimley-Horn) t
conduct a periodic reassessment of the City's transportation impact fees and to prepare a repo it m
on the appropriateness of the City's current impact fees; and
WHEREAS, Kimley-Horn has prepared a report titled "Transportation Impact Fed-
Update"dated September 25, 2015; and
WHEREAS, this Ordinance is enacted pursuant to the Florida Municipal Tome.Rue.,
Powers Act, Chapter, Florida Statutes, the City of Zephyrhills Comprehensive Plan, and"other'
applicable law authorizing a municipality to set rates, fees, and charges for new development;
and
WHEREAS, it is in the ,best interests of the public health, safety, and welfare of the
citizens of Zephyrhills to amend the City's Transportation impact fees.
NOW,-THEREFORE, THE CITY--COUNGKIL-OF THE--CITY OF-ZEPHYRHILLS- -HEREBY ORDAINS,AS FOLLOWS:
Section 1. Amending Ordinance 1003-08, Section 6, Adoption of Impact Fee Study, and
the.same is hereby, amended to read as follows:
The Council hereby adopts and incorporates, by reference the following Impact Fee Upda e
Study:

City of Zephyrhills, Florida, Transportation Impact Fee Update, dated September 10,
2015, prepared by Kimley-Horn and Associates, Inc., hereto attached.
Section 2. REPEALER.
Any ordinance or part of any ordinance, in conflict herewith is hereby repealed to the extent of
any conflict.
Section 3. SEVERABILITY.
It is declared to be the intent of the City Council of the City of Zephyrhills, Florida, that if an�
section, subsection, sentence, clause, or provision of this Ordinance shall be declared invalid, the
remainder of this Ordinance shall be construed as not having contained said section, subsectio
sentence, clause, or provision and shall not be affected by such holding.
Section 4. INCLUSION IN CODE.
The provisions of this Ordinance shall become and be made part of the Code of the City of
Zephyrhills, Florida. The sections of this Ordinance may be renumbered or re-lettered and the
word "ordinance" may be changed to "section", "article" or such other appropriate word or
