(0 AN ORDINANCE AMENDING THE COMPREHENSIVE PLAN OF THE
CITY OF ZEPHYRHILLS, FLORIDA; AMENDING THE FUTURE
LAND USE ELEMENT TO RE-ESTABLISH THE FUTURE LAND USE
CATEGORY TITLED ESTATE RESIDENTIAL (ER)AND SUBMITTING
SAME TO THE STATE LAND PLANNING AGENCY AND OTHER
AGENCIES PURSUANT TO SECTION 163.3191, FLORIDA STATUTES;
PROVIDING FOR SEVERABILITY, REPEALER, AND AN EFFECTIVE
DATE.
WHEREAS, Chapter 166, Florida Statutes, empowers the City Council of_the City of
Zephyrhills,Florida to prepare and enforce a comprehensive plan for the future development of
the City; and
WHEREAS,the City Council has determined that an additional amendment to the,
Comprehensive Plan is needed, and city staff has conducted the necessary research and analysis
in support thereof; and
WHEREAS, Zephyrhills City Council adopted a Comprehensive Plan on June_20; 1989 d
since that time has been subsequently amended; and
WHEREAS, due public notice of hearing on the proposed text amendment was provided on M y
30, 2013 as required by the Zephyrhills Land Development Code, as amended, and Chapters 1 3
and 166, Florida Statutes; and
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Zephyrhill ,
Florida, as follows:
SECTION 1. The Zephyrhills Comprehensive Plan is hereby amended as follows:
1.) Pg. LU-7: general strike through(see attachment#1);
2.) Pg. LU-8: New page added — Proposed Residential Estate Future Land Use M p
category (see attachment#2);
3.) Pg.'s LU- 33 - 35: Add proposed Residential Estate Future Land Use Map catego
(see attachment#3);
4.) Pg. LU-40: Amend Policy LU-1-2-1 to include proposed Residential Estate Future
Land Use Map category (see attachment#4) PAULA S.0'NE IL,Ph.D.PASCO CLERK & COMP ROLLER

SECTION 2. Repealer. OR BK 89'2 PG 208
Any ordinance or part of any ordinance, in conflict herewith is hereby repealed to the extent .f
any conflict.
SECTION 3. Severability.
It is declared to be the intent of the City Council of the City of Zephyrhills, Florida, that if
section, subsection, sentence, clause, or provision of this Ordinance shall be declared invalid, t e
remainder of this Ordinance shall be construed as not having contained said section, subsectio ,
sentence, clause, or provision and shall not be affected by such holding.
SECTION 4. Inclusion in Code.
The provisions of this Ordinance shall become and be made a part of the Land•Developme t
Code of the City of Zephyrhills, Florida. The sections of this Ordinance may be renumbered r
re-lettered and the word "ordinance" may be changed to "section", "article" or such oth r
appropriate word or phrase in order to accomplish such.
SECTION 5. Effective Date.

The effective date of this plan amendment, if the amendment is not timely challenged, shall be
31 days after the state land planning agency notifies the local government that the plan
amendment package is complete. If timely challenged, this amendment shall become effective
on the date the state land planning agency or the Administration Commission enters a final order
determining this adopted amendment to be in compliance. No development orders, development
permits, or land uses dependent on this amendment may be issued or commence before it has
become effective. If a final order of noncompliance is issued by the Administration
Commission, this amendment may nevertheless be made effective by adoption of a resolution
affirming its effective status, a copy of which resolution shall be sent to the state land planning
agency.
