c.1 / AN ORDINANCE AMENDING THE COMPREHENSIVE PLAN OF THE
CITY OF ZEPHYRHILLS, FLORIDA; AMENDING THE FUTURE
LAND USE ELEMENT (MIXED USE ' FUTURE LAND USE
CLASSIFICATION) TO INCREASE THE EXISTING FLOOR AREA
RATIO FROM .5 TO 1.0 AND SUBMITTING SAME TO THE STATE
LAND PLANNING AGENCY AND OTHER AGENCIES PURSUANT TO _.
SECTION 163.3191, FLORIDA STATUTES; PROVIDING FOR
SEVERABILITY, REPEALER,AND AN EFFECTIVE DATE.
WHEREAS, Chapter 166, Florida Statutes, empowers the City Council-o f the City of
Zephyrhills, Florida to prepare and enforce a comprehensive plan for the future development of
the City; and
WHEREAS,the City Council has determined that an additional amendment to the
Comprehensive Plan is needed, and city staff has conducted the necessary research and analysis
in support thereof; and
WHEREAS, Zephyrhills City Council adopted a Comprehensive Plan on June 20; 1989 and
since that time has been subsequently amended; and - -
WHEREAS, due public notice of hearing on the proposed text amendment was provided on
January 30, 2014 as required by the Zephyrhills Land Development Code, as amended, and
Chapters 163 and 166, Florida Statutes; and
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Zephyrhills,
Florida, as follows:
SECTION 1. The Zephyrhills Comprehensive Plan is hereby amended as follows:
1.) Pg. LU-15: changing the existing Floor Area Ratio from .5 to 1.0 in the Mixed Use
Future Land Use classification;

SECTION 2. Repealer. 08/28/14 D. Bonilla, Dpty Clerk
Any ordinance or part of any ordinance, in conflict herewith is hereby repealed to the extent o'

It is declared to be the intent of the City Council of the City of Zephyrhills, Florida, that if any
section, subsection, sentence, clause, or provision of this Ordinance shall be declared invalid, the
remainder of this Ordinance shall be construed as not having contained said section, subsection,
sentence, clause, or provision and shall not be affected by such holding.
SECTION 4. Inclusion in Code.
The provisions of this Ordinance shall become and be made a part of the Land Development
Code of the City of Zephyrhills, Florida. The sections of this Ordinance may be renumbered or
re-lettered and the word "ordinance" may be changed to "section", "article" or such other
appropriate word or phrase in order to accomplish such.
SECTION 5. Effective Date.
The effective date of this plan amendment, if the amendment is not timely challenged, shall be
31 days after the state land planning agency notifies the local government that the plan
amendment package is complete. If timely challenged, this amendment shall become effective
on the date the state land planning agency or the Administration Commission enters a final order
determining this adopted amendment to be in compliance. No development orders, development

permits, or land uses dependent on this amendment may be issued or commence before it has
become effective. If a final order of noncompliance is issued by the Administration
Commission, this amendment may nevertheless be made effective by adoption of a resolution
affirming its effective status, a copy of which resolution.shall be sent to the state land planning
