McBee, Dpty Clerk / 2014081794 ORDINANCE NO.: 1230-14 AN ORDINANCE OF THE CITY OF ZEPHYRHILLS, FLORIDA AMENDING THE ZEPHYRHILLS LAND DEVELOPMENT CODE TO m ti CHANGE THE ZONING ON LAND HEREINAFTER DESCRIBED FROM CITY ZONING CATEGORY M1 (MOBILE HOME SUBDIVISION) TO o CITY ZONING CATEGORY PUD (PLANNED UNIT DEVELOPMENT) z IN ACCORDANCE WITH THE PROVISIONS OF SECTION 166.041, (Do FLORIDA STATUTES; PROVIDING FOR CODIFICATION, CONFLICT, SEVERABILITY,AND AN EFFECTIVE DATE. I�3 N n ~o -WHEREAS; Grand-Horizons,Inc.,-the--ow et of-land_hereinafter described in Section 2 belo , ° m did petition on the 30th day of January, 2014 for rezoning of said land; and jaw WHEREAS, the City Council has been given authority by the State of Florida pursuant t i o Chapters 166 and 163, Florida Statutes, to rezone property within the City limits upon receipt f written consent of the land owner, together with the approval of the City Council of sai rezoning duly expressed by Ordinance; and WHEREAS, due public notice of hearing on the proposed rezoning, was given by the Cit, Council on April 3, 2014, as required by the Zephyrhills Land Development Code,,as amende , and Chapters 163 and 166, Florida Statutes; and WHEREAS, the Planning Commission, sitting as the Local Planning Agency, didiiold a publi hearing on March 11, 2014 to consider said proposed rezoning; and WHEREAS, the City Council has determined that the PUD (Planned Unit Development) zonin category would be appropriate, would promote the general welfare, and: encourage prop r development within the City. NOW, THEREFORE, BE IT ENACTED AND ORDAINED BY THE CITY COUNCI OF ZEPHYRHILLS, FLORIDA, AS FOLLOWS: Section 1: The above Whereas clauses are hereby adopted and incorporated herein" Section 2: The following described lands, lying and being situated in Pasco Cduhty;'to wit: SEE EXHIBIT "A" ATTACHED HERETO PARCEL I.D. NOs. ,34-25-21-0090-00000-00C0 2.15 acres m.o.l. is hereby rezoned and included within the boundaries of the City of Zephyrhills, Florida subje t to the following conditions: 1. Petitioner/future property owner(s) shall be required to vacate Tract "D" o subject property (Tract C) and provide for a new entrance from Green Slope D . to-the subject property; 2. Future development/redevelopment shall be in compliance with the submitte "Agreement"Ex. A-D.; 3. Future use of the subject building shall be required to obtain a City commerci 1 check to ensure future use is permissible and the subject property/structure(s) ar up to present code; 4. Future development/redevelopment of the subject property shall be subject to Ci of Zephyrhills Codes, Ordinances and Regulations; 5. Future development/redevelopment may require an emergency ingress/egress access for emergency purposes only and shall be locked and equipped with "knox box." Fencing required by the attached Agreement as referenced in condition No. 2, shall be constructed along the boundary of those portions of Tract C that abut Lot 235, Lilly Bea Ave. and Slater Ave. as platted in Plat Book 53 page 123, and that portion of Tract C that abuts New Horizons Blvd. as platted in Book 34 Page 100, and shall be constructed in the location as permitted by the City considering any required setbacks, clear zones, etc. The fencing along lot 235 shall be installed perpendicular from Green Slope Dr. to the intersection of Kay Marie and Lilly Bea Ave. Section 3: All ordinances or parts of ordinances in conflict herewith are hereby repealed to the extent of such conflict. Section 4: That if any section, sentence,clause, or phrase of this ordinance is held to be invalid or unconstitutional by a court of competent jurisdiction, then said holding shall in no way affect the validity of the remaining portions of this ordinance.
