A RESOLUTION RESCINDING MEMORANDUM REGARDING
INTERPRETATION OF ORDINANCE NO. 395 DATED OCTOBER 24,
1991 REGARDING UTILITY BASE RATES; PROVIDING AN
EFFECTIVE DATE:
WHEREAS, on April 14, 1996 Ordinance 395 was passed upon its third reading.
WHEREAS, on October 24, 1991,then City Manager Nick Nichols penned an Interpretation o
Ordinance 395 regarding the applicability of base rates.
WHEREAS,the City Council after being fully informed hereby find that it is in the City's best
interest to rescind, overrule and otherwise find void the memorandum authored by Nick Nichols
regarding interpretation of Ordinance No. 395.
NOW THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF ZEPHYRHILLS,FLORIDA:
Section 1. The foregoing findings are incorporated herein by reference and made a part hereof.
Section 2. The memorandum from Nick Nichols to Mayor and City Council dated October 24,
1991 is hereby overruled, rescinded and otherwise held invalid, and the Ordinance shall be
interpreted according to its plain meaning.
Section 3. This Resolution shall take effect on January 1, 2011.

an opeif.and regular meeting of the City Council of the City of Zephyrhills, Florida, on this 9
day of August,-,2010.
