A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ZERPHYRHILLS, FLORIDA PROVIDING FOR REFUND OF UTILITY
DEPOSITS.
WHEREAS, through the authorization of the City Council of the City of Zephyrhills, the Ci
requires the collection of deposits for utility services; and
WHEREAS, Resolution 606-08, approved on August,11, 2008, determined it was in the bes
interest of the citizens to repeal Resolution 138 that provided for the refund of utility deposits;
and
WHEREAS, the City Council of the City of Zephyrhills desires to now provide a policy and;
procedure for the refund of utility deposits to residential customers who had utility service wit
the City of Zephyrhills prior to August 11, 2008.
NOW, THEREFORE BE IT RESOLVED, in a regular meeting of the City Council of the City o
Zephyrhills as follows:
1. Utility deposits shall be refunded to residential customers whom meet all of the followin
criteria:
a. were a utility customer prior to August 11, 2008;
b. had uninterrupted service for a period of not less than 24 continuou
monthly billing cycles;
c. have had no checks returned for insufficient funds or otherwise for at least 1
months;
d. no turn-offs due to non-payment for at least 12 months, and
e. no late fees for at least 12 consecutive months.
2. As of August 12, 2008 a security deposit shall be required for services to be maintained wit
no provision for refund until the account is closed.
3. The refund shall be in a manner by which the City chooses.
4. Utility deposits shall be held in non-interest bearing accounts.
5. Customers who do not meet the above criteria will have their deposit applied to their fins
bill, and any unused balance will be refunded, without interest, to the individual listed on th
account.
The provisions of this Resolution shall become effective on June 14, 2011.
PASSED AND ADOPTED by the City Council of the City of Zephyrhills, Florida, on this 13th
day of June, 2011. -
