A RESOLUTION OF THE CITY OF ZEPHYRHILLS, FLORIDA,
RELATING TO COMMUNITY REDEVELOPMENT PURSUANT TO
CHAPTER 163, PART III, FLORIDA STATUTES (THE "COMMUNITY
REDEVELOPMENT ACT"); SAID RESOLUTION BEING SUPPORTED
BY DATA AND ANALYSIS; DEFINING THE CITY OF ZEPHYRHILLS
COMMUNITY REDEVELOPMENT EXPANSION AREA; FINDING THE
EXISTENCE OF CONDITIONS IN THE CITY OF ZEPHYRHILLS
COMMUNITY REDEVELOPMENT AREA THAT WARRANT THE
EXPANSION OF THE COMMUNITY REDEVELOPMENT AREA;
MAKING A LEGISLATIVE FINDING THAT CONDITIONS IN THE CITY
OF ZEPHYRHILLS COMMUNITY REDEVELOPMENT EXPANSION
AREA MEET THE CRITERIA DESCRIBED IN SECTION 163.340 (7) OR
(8), FLORIDA STATUTES ("FINDING OF NECESSITY"); PROVIDING
FOR FILING WITH THE CITY CLERK; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, the Florida Legislature duly enacted Chapter 163, Part III, Florida Statute
(the "Community Redevelopment Act") establishing the conditions and procedures fo
the establishment or expansion of community redevelopment areas and agencies; an
finding that areas or portions thereof which are deteriorating or economically distresse
could be revitalized and redeveloped in a manner that will vastly improve the economi
and social conditions of the community; and
WHEREAS, the City of Zephyrhills held Community Redevelopment Board and City
Council meetings on September 27, 2010 and December 13, 2010 to consider the nee
for expanding the Community Redevelopment Area in the City of Zephyrhills; and
WHEREAS, the City of Zephyrhills commissioned Kimley-Horn and Associates, Inc. t
prepare an independent finding of necessity analysis of the City; and
WHEREAS, the City of Zephyrhills Community Redevelopment Board, following a
advertised public workshop meeting reviewed the independent Communit
Redevelopment Area Finding of Necessity analysis prepared by Kimley-Horn an
Associates, Inc. ( a copy of a summary of the findings is attached as Exhibit 'A' attache
hereto), considered public input, the recommendation of the staff, and the standard
and guidelines of Chapter 163, Part III, and agreed to proceed with consideration t
expand the City's community redevelopment area; and
WHEREAS, pursuant to Section 163.346, Florida Statutes, the City of Zephyrhills ha
provided public notice of its intent to consider adopting a resolution declaring a findin
of necessity for expansion of the City of Zephyrhills Community Redevelopment Area a
least fifteen (15) days before such proposed action by registered mailed notice to eac
taxing authority which levies ad valorem taxes on real property contained within th
geographic boundaries of the proposed expansion of the redevelopment area and i
compliance with the notice requirements set forth in Section 166.041(3)(a), Florid
Statutes; and
WHEREAS, conditions are present which are detrimental to the sound growth of th
City of Zephyrhills Redevelopment Area expansion and which substantially impair o
arrest appropriate growth within the area, and present conditions and uses which ar
detrimental to the public health, safety, morals and public welfare; and
WHEREAS, the City of Zephyrhills Community Redevelopment Area Finding o
Necessity analysis confirmed that: conditions in the expansion area meet the criteri
described in Section 163.340 (7) or (8), blighted areas exist within the Communit
Redevelopment Area expansion, and the rehabilitation, conservation, or redevelopmen
of the Community Redevelopment Area expansion is necessary and in the interest o
public health, safety, morals or welfare of the residents of the City of Zephyrhills; and
WHEREAS, the Community Redevelopment Area expansion is an area that is
deteriorating and economically distressed due to outdated building density patterns,
inadequate transportation and parking facilities, faulty lot layout and inadequate street
layout; and
WHEREAS, within the Community Redevelopment Area expansion there is a
predominance of defective or inadequate street layout, parking facilities, roadways,
drainage facilities, or other public infrastructure; and
WHEREAS, aggregate assessed values of real property in the Community
Redevelopment Area expansion for ad valorem tax purposes have failed to show any
appreciable increase and in fact for some properties within the expansion area such
values have declined at rates significantly greater than that of the.City of Zephyrhills and
Pasco County as a whole; and
WHEREAS, within the Community Redevelopment Area expansion there exists faulty
lot layout in relation to size, adequacy, accessibility, or usefulness; and
WHEREAS, within the Community Redevelopment Area expansion there exists unsafe
or unsanitary conditions; and
WHEREAS, within the Community Redevelopment Area expansion there exists
inadequate or outdated building density patterns; and
WHEREAS, within the Community Redevelopment Area expansion there exists a
substantial commercial vacancy rate; and
WHEREAS, the Community Redevelopment Area expansion exhibits a diversity of
ownership and unusual property configurations which prevent the free alienability of
land; and
WHEREAS, within the Community Redevelopment Area expansion there exists a
significant degree of nonconformities relative to parking, stormwater management,
landscaping, architectural design and community standards; and
WHEREAS, the City of Zephyrhills Redevelopment Area expansion can be revitalized
and redeveloped in a manner that will vastly improve the economic and social
conditions of the community; and
WHEREAS, after considering the recommendation of the Community Redevelopment
Board and after providing proper notice to all taxing authorities which levy ad valorem
taxes on real property in the redevelopment area expansion, and providing the public an
opportunity to present testimony and evidence, the City Council, finds as a matter of fact
that conditions exist which warrant the expansion of the community redevelopment
area.
NOW THEREFORE, BE IT RESOLVED BY THE ZEPHYRHILLS CITY COUNCIL,
THAT:
Section 1. Recitals. The above recitals are true and correct, are hereby accepted as
legislative findings of fact, and incorporated into this Resolution by this reference.
Section 2. Approval. This Resolution is supported by data and analysis and the City
Council makes a legislative finding of fact that the conditions in the City of Zephyrhills
Community Redevelopment Area expansion meet the criteria described in Section
163.340 (7) or (8), Florida Statutes. The City Council adopts the Community
Redevelopment Area Finding of Necessity summary analysis prepared by Kimley-Horn
and Associates, Inc. ("Exhibit A", attached hereto) and in accordance with Section
163.356, Florida Statutes finds that there is a need for expansion of the community
redevelopment area for the City of Zephyrhills. The geographic area of the City of
Zephyrhills Redevelopment Area expansion is designated as depicted on the map
attached hereto as "Exhibit B".
Section 3. Recordation Required. This Resolution relating to the City of Zephyrhill
Community Redevelopment Area expansion shall be recorded in the Minutes of thi
Board and filed with the City of Zephyrhills City Clerk's Office.
Section 4. Effective Date. This Resolution shall take effect immediately upon adoption.

the Zephyrhills City Council on the 1 1th day of April 2011.

EXHIBIT`A'
SUMMARY FINDING OF NECESSITY ANALYSIS
The City has identified four potential expansion areas for consideration including the Hercules Park Community Area,Historic Area,Shepar
Park Community Area and the Lake Zephyr Park Community Area. These areas vary in size and overall impact on the CRA;however each o
these areas serves as a"gateway"to the existing CRA district.
Hercules Park Community Area is approximately 68 acres located adjacent to the northern CRA boundary,extending along Gall Boulevard t
Eiland Boulevard. This area includes primarily commercial (retail) and automobile oriented land uses, Hercules Park and residential use
primarily in the form of mobile home parks/subdivisions. This area also includes an FDOT streetscape improvement project extending fro
approximately 16th Avenue to north of Henry Drive.
The Historic Area includes properties located adjacent to and east of the existing CRA boundary along 5"'Avenue,to 17"Street encompassin
approximately 13 acres. This area includes a small portion of the City's Historic District. The primary land use within this expansion area is th
civic including the Chamber of Commerce,and two larger religious institutions;there are also single family residential and some vacant land use
within this area.
Shepard Park Community Area is approximately 14 acres located at the southern boundary of the CRA extending south along Gall Boulevar
from South Avenue to C Avenue. This area contains a mix of non-retail commercial,vacant properties and Shepard Park,a two-acre passiv
recreational facility. There are also limited residential properties in this area,primarily on the east side of Gall Boulevard.
Lake Zephyr Community Area is the smallest of the possible expansion areas including approximately 15 acres located on western boundary o
the CRA along 5"'Avenue,from 1'Street west to the existing City limits. This area contains retail/commercial,automobile oriented commercial
and industrial uses. This area also contains some limited residential uses including a mobile home park on the north side of 5"'Avenue.
