• A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF
ZEPHYRHILLS, FLORIDA, DECLARING A STATE OF EMERGENCY
AND WAIVING FORMALITIES AND PROCEDURES OTHERWISE
REQUIRED OF POLITICAL SUBDIVISIONS.
WHEREAS, on June 13, 2011 the Governor of the State of Florida issued Executiv
Order No. 11-28, declaring that'a state of emergency exists in the State of Florida due to th
ongoing danger of wildfires which continue to "threaten the State of Florida with a major disaster,'
and;
WHEREAS, the Florida Division of Forestry, Withlacoochee Forestry Center, is reportin
that the wildfire risk in Lake, Citrus, Sumter, Hernando, and Pasco Counties is now at a very hig
level, and is recommending that outdoor burning of yard waste be delayed until conditions improve;
and
WHEREAS, the City Council of Zephyrhills, Florida, has declared a state of loc
emergency,pursuant to Chapter 166 of the Florida Statutes;and
WHEREAS, Section 166.041 of the Florida Statues provides authority for a politic
subdivision such as Zephyrhills to declare a state of local emergency and to waive the procedure
and formalities otherwise required of political subdivisions by law pertaining to the adoption of
ordinance due to emergency conditions; and
WHEREAS, pursuant to such legal authority this Council adopted Emergency Drough
Condition Fire Hazard Ordinance No. 1034-09 on March 9,2009;and
WHEREAS, said ordinance provides for implementation by adoption of an approximat
resolution.
NOW, THEREFORE, BE IT RESOLVED by the City Council of Zephyrhills in regul
session,duly assembled,that:
(1) by the legal authority of the adoption of Emergency Drought Condition Fire Hazar
Ordinance No. 1034-09, this Council finds that the drought like conditions.occurring in the City
Limits of Zephyrhills and surrounding Pasco County for the past several months due to lack o
adequate rainfall pose a serious threat to the lives and property of residents by making Zephyrhill
susceptible to wildfires, and that a state of local emergency for all unincorporated territory wi
the legal boundaries of the City of Zephyrhills,Pasco County, Florida, is hereby found to exist, an
Emergency Drought Condition Fire Hazard Ordinance No. . 1034-09 is declared effectiv
immediately,and
(2) this resolution shall remain in full force and effect until September 1,2011.
