A RESOLUTION BY THE CITY OF ZEPHYRHILLS, PASCO COUNTY,
FLORIDA, DESIGNATING AN ECONOMIC INCENTIVE ZONE AS SET
FORTH IN EXHIBIT "A" ATTACHED HERETO FOR THE PURPOSE OF
ENVIRONMENTAL SITE REHABILITATION •AND ECONOMIC
DEVELOPMENT; PROVIDING FOR FINDINGS; PROVIDING FOR
ADOPTION; AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, pursuant to sections 376.77-376-85, Florida Statutes, the
"Brownfield Redevelopment Act" (the "Act"), the State of Florida has provided for the
designation of certain contiguous areas consisting of one or more Brownfield sites as
"Brownfield areas" by resolution and for the corresponding provision of economic
development and environmental remediation for such areas, and;
WHEREAS, the City desires to provide for the designation of a Brownfield Area,
identification of the person responsible for Brownfield site rehabilitation, and notification
of the Florida Department of Environmental Regulation (FDEP) of its decision to
designate a Brownfield Area pursuant to the Act; and;
WHEREAS, the City has complied with the notice and public hearing
requirements set forth in Section 376.80(1) and (2)(a) and 125.66(4)(2)(b), Florida
Statutes, and two public hearings were held on the proposed designation; and,
WHEREAS, the City has considered the criteria set forth in Section 376.80(2)(a),
Florida Statutes, including whether the proposed Zephyrhills Airpark Economic Incentive
Area warrants economic development and has a reasonable potential for such activities;
whether the proposed area represents a reasonably focused approach and is not overly
large in geographic coverage; whether the area has potential to interest the private
sector in participating in rehabilitation; and whether the area contains sites or parts of
sites suitable for limited open space, cultural, or historical purposes; and,
WHEREAS, the Pasco County Board of County Commissioners has also
designated adjacent parcels to be an Economic Incentive Zone.
NOW, THEREFORE, BE IT RESOLVED by the Zephyrhills City Council 'in
regular session duly assembled that:
1. The proposed project area warrants economic development and has a
reasonable potential for such activities; the proposed project area has the potential to
interest the private sector in participating in rehabilitation; the proposed project area
contains sites.or parts of sites suitable for limited recreational open space, cultural, o
historical preservation purposes; and the project area represents a focused approach to
redevelopment efforts to targeted business and industries for Zephyrhills and is not
overly large in.geographic coverage.
2. The area, approximately 1160.45 acres of land in Zephyrhills near
Zephyrhills Airport, more particularly described on Exhibit A, attached hereto and
incorporated herein by reference, is hereby designated as an "Economic Incentive
Zone" (Brownfield area) in accordance with the Act and is hereinafter referred to as
"Zephyrhills Airpark Economic Incentive Area."
3. The City Manager or his designee is hereby authorized and directed to
notify the FDEP of this designation of a Brownfield Area.
4. The City Manager or his designee is hereby authorized and directed to
notify the FDEP of the identification of the persons responsible for Brownfield site
rehabilitation when there is a person or persons who has assumed responsibility for
rehabilitation of sites within the designated Brownfield Area.

5. This designation shall not render the City of Zephyrhills liable for costs of
site rehabilitation or source removal, as those terms are defined in the Act, or for any
other costs above and beyond those costs attributable to the City's role as administrator
of the Brownfield program within the designated Zephyrhills Airpark Economic Incentive
Area.
6. This Resolution shall take effect immediately upon its adoption.
