HomeMy WebLinkAbout656-12 Conditional Use for Day Care 15th Avenue RESOLUTION NO. 656-12 A RESOLUTION RELATING - TO ZONING; APPROVING A CONDITIONAL USE TO ALLOW DAY CARE LOCATED AT 38112 15tH AVENUE; FINDING CONFORMITY WITH THE LAND DEVELOPMENT CODE; PROVIDING AN EFFECTIVE DATE. WHEREAS, an application was filed by Molly Sheuerman for a conditional use to allow a da care located at 38112 15th Avenue; and WHEREAS, Ordinance 1153-12 was approved July 23, 2012 amending the Land Developmen Code for allowable uses in zoning districts; and day cares are listed as a conditional use unde zoning district C-2; and WHEREAS,the Staff of the Planning Department recommended approval of the conditional us with the following conditions: WHEREAS, staff and the Planning Commission recommended approval of the conditional us with the following conditions: (1) The holder of a conditional use permit shall be authorized to utilize the site or location o the use only in the manner specified in the written approval and conditions specified therein Any substantial expansion, alternation or change in the conditional use authorized by the writte approval must be reviewed by the City Council in the same manner in which the origins conditional use was reviewed; (2) For purpose of this section, an expansion, alteration or change of a conditional use shal be deemed to exist where a substantial modification of any of the standards provided for i condition in paragraph (1) above, results from activity associated with the conditional use o where a substantial change of circumstances or conditions arises; (3) The conditions and stipulations shall become part of the written approval and must b conformed to or followed by the applicant or any successor in interest; (4) The conditional use approval shall run with the current ownership and lessee. All futur issues related to the subject use and identified by• City Staff shall be presented to an satisfactorily addressed by the owner/lessee; (5) Proposed six foot fence shall include a opaque barrier throughout the entire fence. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF T CITY OF ZEPHYRHILLS,FLORIDA: Section 1. The foregoing findings are incorporated herein by reference and made a part hereof. Section 2. The conditional use is approved for the benefit of the applicant only and for the use a specified within the application only, subject to the conditions herein. The character or benefi of this conditional use shall not be changed or transferred without City Council approval b resolution. Section 3. The City Council does hereby expressly find that the provisions of this resolution ar in conformity with the Land Development Code of the City of Zephyrhills, as amended. Section 4. This Resolution shall take effect immediately upon its passage and signing by th Mayor.
