A RESOLUTION RELATING TO ZONING; APPROVING A
CONDITIONAL USE TO ALLOW DAY CARE LOCATED AT 5320 1St
STREET; FINDING CONFORMITY WITH THE LAND DEVELOPMENT
CODE; PROVIDING AN EFFECTIVE_DATE.
WHEREAS, an application was filed by Betty Dyson for a conditional use to allow a day car
located at 5320 1St Street; and
WHEREAS, Betty Dyson was granted a conditional use to allow a day care at 5320 1St Street fo
one year on June 27, 2011; and
WHEREAS, day cares are listed as a conditional use under zoning district R-3; and
WHEREAS, staff and the Planning Commission recommended approval of the conditional us
with the following conditions:
(1) Petitioner shall be responsible for payment of additional transportation impact fees whe
exceeding enrollment of 28 students;
(2) Applicant shall be authorized to utilize the site or location of the use only in the manne
specified in the written approval as a daycare. Any substantial expansion, alteration or change i
the conditional use authorized by the written approval must be reviewed by the City council i
the same manner in which the original conditional use was reviewed;
(3) An expansion, alteration or change of a conditional use shall be deemed to exist where
substantial modification of any of the standards .results from activity associated with th
conditional use or where a substantial change of circumstances or conditions arise.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF T
CITY OF ZEPHYRHILLS,FLORIDA:
Section 1. The foregoing findings are incorporated herein by reference and made a part hereof.
Section 2. The conditional use is approved for the benefit of the applicant only and for the use a
specified within the application only, subject to the conditions herein. The character or benefi
of this conditional- use shall not be changed or transferred without City Council approval b
resolution.
Section 3. The City Council does hereby expressly fmd that the provisions of this resolution ar
in conformity with the Land Development Code of the City of Zephyrhills, as amended.
Section 4. This Resolution shall take effect immediately upon its passage and signing by th
Mayor.
The foregoing Resolution No. 658-12 was read and passed, following a public hearing, in a
open and regular meeting of the City Council of the City of Zephyrhills, Florida, on this 28th da
of January, 2013.
