A RESOLUTION RELATING TO ZONING; APPROVING A
CONDITIONAL USE TO ALLOW A PROPOSED ACCESSORY
STRUCTURE THAT EXCEEDS 625 SQUARE FEET LOCATED AT 5050
16th STREET; PROVIDING AN EFFECTIVE DATE.
WHEREAS, an application was filed by Aaron Zook for a conditional use to allow an accessory
structure that exceeds 625 square feet; and
WHEREAS, the conditional use is consistent with the standards as reflected in the City's Land
Development Code Section 11.10.00; and
WHEREAS, Planning Commission recommended approval of the conditional use with the
following conditions:
(1) The holder of a conditional use permit shall be authorized to utilize the site or location o
the use only in the manner specified in the written approval and conditions specified therein.
Any substantial expansion, alteration or change in the conditional use authorized by the written
approval must be reviewed by the City Council in the same manner in which the original
conditional use was reviewed:
(2) Alteration or change of a conditional use shall be deemed to exist where a substantial
modification of any of the standards provided for in condition (1) above, results from activity
associated with the conditional use or where a substantial change of circumstances or conditions
arises:
(3) The subject conditions and stipulations shall become part of the written approval and
must be conformed to and followed by the applicant or any successor in interest:
(4) The conditional use approval shall run with the ownership of subject property:
(5) The proposed garage shall comply with the following agreed to standards: a) garage roof
shall not exceed 15 feet 11 inches in height; b) structure will include two front/separate garage
doors, a side door and 5 windows; c) construction material/siding (hardi board), metal roof to
match that of the future primary residence; d) landscape strip to be placed along the east, south
and west sides of the building.
(6) The future residence to be built on site will be compatible/consistent with building/roof
materials.
(7) No Certificate of Occupancy ("CO") shall be issued for the subject accessory building
until the existing home is demolished and all debris is removed from the property.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF ZEPHYRHILLS,FLORIDA:
Section 1. The foregoing WHEREAS clauses are incorporated herein by reference and made a
part hereof.
Section 2. The conditional use is approved for the benefit of the applicant only and for the use as
specified within the application only, subject to the conditions herein. The character or benefit
of this conditional use shall not be changed or transferred without City Council approval by
resolution.
Section 3. The City Council does hereby expressly find that the provisions of this resolution are
in conformity with the Land Development Code of the City of Zephyrhills, as amended.
Section 4. This Resolution shall take effect immediately upon its passage and signing by the
Mayor.
• The foregoing Resolution No. 678-14 was read and passed, following a public hearing, in an
open and regular meeting of the City Council of the City of Zephyrhills, Florida, on this 9th day
of June, 2014.
