A RESOLUTION OF THE CITY OF ZEPHYRHILLS, FLORIDA
IMPOSING A TEMPORARY MORATORIUM ON THE ISSUANCE OF
ANY PERMIT, DEVELOPMENT ORDER, SITE PLAN APPROVAL AND
ANY OTHER OFFICIAL ACTION OF THE CITY OF ZEPHYRHILLS
HAVING THE EFFECT OF PERMITTING OR ALLOWING THE
CONSTRUCTION, OPERATION OR ERECTION OF AN ELECTRONIC
SIGN OR AN ANIMATED SIGN; THE TEMPORARY MORATORIUM
SHALL APPLY TO ALL REAL PROPERTY LOCATED WITHIN THE
CORPORATE LIMITS OF THE CITY OF ZEPHYRHILLS; PROVIDING
FOR SEVERABILITY; CONFLICTS AND AN EFFECTIVE DATE.
WHEREAS, electronic signs and animated signs are a recent technological innovation used for
signage, primarily due to their unusually strong and effervescent light and intensity; and
WHEREAS,there is a strong likelihood that electronic sign and animated signs will proliferate
throughout the City causing sign-induced visual blight, causing a decrease in property values,
threatening the aesthetics of the City, causing traffic safety problems by way of distraction from
attentive driving, thus threatening the public health, welfare and safety of the City; and
WHEREAS,the proliferation of electronic signs and animated signs may become a safety
hazard for motorists, and
WHEREAS,the City of Zephyrhills has found that it is necessary to impose a temporary
moratorium to allow sufficient time for the City to study, review,prepare and adopt new
regulations for electronic signs and animated signs; and
WHEREAS, a temporary moratorium on permitting the construction or erection of electronic
C signs and animated signs will result in identification of the most appropriate regulation of
electronic signs and animated signs for the City,the protection and enhancement of adjacent
uses, and the adoption of a revised regulatory ordinance, as appropriate; and
WHEREAS,the City Council finds that it is essential to protect and preserve the aesthetics, the
environment and public health,welfare and safety of the City and its citizenry, and that it is in
the best interest, and that it is coincident with the Comprehensive Plan for the City to study the
impact and use of electric signs and animated signs within the City; and
WHEREAS,the City Council after holding a public hearing, finds that it is appropriate to
impose a temporary moratorium on the construction, operation and erection of electronic signs
and animated signs; and
NOW,THEREFORE, BE IT ENACTED, by the City Council of the City of
Zephyrhills, Florida:
Section 1. The above Whereas clauses are hereby included by reference.
Section 2. A moratorium on the construction or erection of electronic signs and animated
signs is hereby imposed until 11:59 p.m., on Tuesday, March 31, 2015.
Section 3. City Staff is hereby directed to conduct research and study the impacts o
electronic signs and animated signs, so that appropriate revisions to the Land Development Cod
and/or the City Code of Ordinances may be recommended by staff and adopted by City Council.
Section 4. SEVERABILITY: It is declared to be the intent of the City Council of the Ci
of Zephyrhills, Florida, that if any section, subsection, sentence, clause, or provision of thi
Resolution shall be declared invalid, the remainder of this Resolution shall be construed as no
having contained said section, subsection, sentence, clause, or provision and shall not be affecte
by such holding.
This Resolution shall take effect upon passage by the City Council and signing by the Mayor.
The foregoing Resolution No. 694-15 was read and passed as an emergency Resolution in an
open and regular meeting of the City Council of the City of Zephyrhills, Florida, on this 9th day
of February, 2015.
