AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
ZEPHYRIJILLS, FLORIDA AMENDING ARTICLE XII, SECTION U
12.01.04.01 OF THE LAND DEVELOPMENT CODE REGARDING
NONCONFORMING LOTS OF RECORD; ALLOWING THE SPLIT
OF NONCONFORMING LOTS OF RECORD IN CERTAIN AREAS ma's
OF THE CITY; PROVIDING FOR A MINIMUM LOT WIDTH FOR
NEW NONCONFORMING LOTS; PROVIDING FOR
SEVERABILITY,REPEALER,AND AN EFFECTIVE DATE.

WHEREAS, Section 12.01.04.01 of the Land Development Code defines a nonconforming lot of
record as a lot created before July 28, 1986 or before the current zoning of the property,which
does not meet minimum lot area requirements for the zoning district in which it is'1`ocated;` i d d J
WHEREAS, many homes in the original core of the City are built on two small lots which, if
split, create nonconforming lots of record; and
WHEREAS, the City Council has determined that it would be consistent with the.-,actualx
development of the downtown core of the City to allow the further split of these lots.
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Zephyrhills,
Florida, as follows:
SECTION 1. Article XII, Section 12.01.04.01, Nonconforming Lot of Record, of the
Zephyrhills Land Development Code is hereby amended as follows:
Where a lot which was a lot of record July 28, 1986, or at the time of change of zoning on the
lot, has an area less than the required minimum area, or has a width or length less than.the
required minimum for the district in which it is located, such lot may be used'for any use
permitted in the district in which it is located, subject to other applicable regulations; Witi
modifications in required setbacks as approved by the Board of Adjustment. In no case shall the
distance between structures on the lot in question and structures on adjacent properties be less
than that required by the Fire Code for the type of construction represented. In any district in
which a single family home is permitted, a single family unit may be erected, expanded,-,altered,
or replaced on any individual single parcel or lot, the legal or equitable title of which has been
legally conveyed prior to the effective date of this Code, notwithstanding,limitations imposedlby
other provisions of this Code.
When two or more adjoining and vacant lots with continuous frontage are in a-single ownership
at the time of application and such lots have frontage or lot area less than is required by the,use
district in which they are located, such lots shall be re-parceled so as to created;one or m_ore lots
which conform to the minimum frontage and area requirements of the use district..;
For properties located within the boundaries of North Avenue, C Avenue, 1St Street and 20th
Street, in single ownership at the time of application, such property must: 1) Be a minimum lot
area of 6,000 square feet; 2) Lot width must be a minimum of 50 feet; 3) Existing platted lot
depths shall not be altered; 4) Current zoning setbacks would be continued; and 5) Any required
utility relocations would be the sole responsibility of the property owner.
SECTION 2. Repealer.
Any ordinance, or part of any ordinance, in conflict herewith is hereby repealed to the extent of
any conflict.
SECTION 3. Severability.
It is declared to be the intent of the City Council of the City of Zephyrhills, Florida, that if any
section, subsection, sentence, clause, or provision of this Ordinance shall be declared invalid, the
remainder of this Ordinance shall be construed as not having contained said section, subsection,
sentence, clause, or provision and shall not be affected by such holding.

SECTION 4. Inclusion in Code.
The provisions of this Ordinance shall become and be made a part of the Land Development
Code of the City of Zephyrhills, Florida. The sections of this Ordinance may be renumbered or
re-lettered and the word "ordinance" may be changed to "section", "article" or such other
appropriate word or phrase in order to accomplish such.
SECTION 5. Effective Date.
This ordinance shall become effective upon passage on the third reading and signing by the
Mayor.
