ORDINANCE NO. 965-07
AN ORDINANCE OF THE CITY OF ZEPHYRHILLS, FLORIDA, A
MUNICIPAL CORPORATION, AMENDING SECTION 51.075 OF THE
CODE OF ORDINANCES, AMENDING ORDINANCE NO. 274, SECTION
32, REGARDING DEPOSITS FOR WATER AND SEWER USERS,
PROVIDING FOR SEVERABILITY, REPEALER, AND AN EFFECTIVE
DATE.
WHEREAS, Section 51.075 of the City of Zephyrhills, Code of Ordinances, dealing
with Water and Sewer rates no longer adequately provides for the needs of the City; and
WHEREAS, to ensure that the Capital Improvement Program is funded with adequate
rate revenue; and
WHEREAS,to ensure that State Revolving Fund loan requirements are met; and
WHEREAS,to promote water conservation.
NOW, THEREFORE,BE IT ORDAINED by the City Council of the City of
Zephyrhills, Florida, as follows:
SECTION 1. That Section 51.075 of the Code of Ordinances of the City of Zephyrhills,
Florida, shall be deleted in its entirety and shall henceforth read as follows:

On the first anniversary of the passage of this ordinance and on each successive
anniversary thereafter,the City Council shall review the above rates.
(D) Base Rate:
(1) Water residential and commercial use: There shall be a base rate for water service
per lot,per month during the period that service is active as follows:

(3) For the purpose of this section, "Lot" shall also include each individual lot,in a
mobile home park and each individual unit of a motel, hotel or apartment. The base
amount shall be in addition to any charge for actual use.

SECTION 2. Ordinance No. 274, Section 32, Rates of Deposit is amended and shall
henceforth read as follows:
SECTION 32. RATES OF DEPOSIT.
Residential:
Individually metered residential and small commercial units receiving both water and
sewer shall pay a deposit in the amount of$120.00. Users of only water or sewer shall pay a
deposit in the amount of$60.00.
SECTION 3. Repealer.
Any ordinance, or part of any ordinance, in conflict herewith is hereby repealed to the extent of
any conflict.
SECTION 4. Severability.
It is declared to be the intent of the City Council of the City of Zephyrhills, Florida, that if any
section, subsection, sentence, clause, or provision of this Ordinance shall be declared invalid,the
remainder of this Ordinance shall be construed as not having contained said section, subsection,
sentence, clause, or provision and shall not be affected by such holding.
SECTION 5. Inclusion in Code.
The provisions of this Ordinance shall become and be made a part of the Land Development
Code of the City of Zephyrhills, Florida. The sections of this Ordinance may be renumbered or
re-lettered and the word"ordinance"may be changed to "section", "article" or such other
appropriate word or phrase in order to accomplish such.

SECTION 6. Effective Date. 4 of 4
This Ordinance shall become effective upon passage on the third reading and signing by the
Mayor.
The foregoing Ordinance No. 965-07 was read and passed on the first reading in an open and
