WHEREAS, Article II, Land Use and Zoning Districts, of the Land Development Code, provides for land use categories and compatible zoning districts; and WHEREAS, the City Council has determined that it would be consistent with the City's 34 . efforts to implement downtown development and, redevelopment to provide for new zoning c categories. .� u a. NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of d Zephyrhills, Florida, as follows: SECTION 1. Article II, Section 2.01.02, Land Use and Zoning Districts, of the Zephyrhills Land Development Code is hereby amended as follows: Land use designations for the City of Zephyrhills are established in the City of Zephyrhills Comprehensive Plan, Future Land Use Element, and indicated on MAP LU-3 Future Land Use -2010. The land use classifications defined in the Future Land Use Element of the City of Zephyrhills Comprehensive Plan and tr delineated on the Future Land Use Map shall be the determinants'of permissible dominant land use on any parcel within the City. This section contains definitions of the various zoning districts compatible with land use classifications. Following is a table of allowable dominant land uses correlated with zoning districts. Article II, Zoning District and Allowed Uses, of the Zephyrhills Land Development Code is hereby amended by adding the following sections: Section 2.01.03.22 Traditional Central Business District(TCBD) This District is established to maintain the character of function of the City's traditional downtown and central business district and to accommodate the renovation, revitalization and planned expansion of the City's core. The District encourages mixed use, the maintenance of a "main street" character, walk ability, public spaces and the sharing of parking and other public infrastructure. Section 2.01.03.23 Traditional Central Business District—Historic (TCBD-H) This District includes those areas within the City's traditional downtown that are also within the boundaries of the Historic District. The District places emphasis on and the preservation of historic resources and the character of the historic district as a part of a vibrant central business district. Section 2.01.03.24 Traditional Mixed Use (TMU) This District includes those areas adjoining the City's traditional central business district and provides transition of intensity and uses to the surrounding residential areas. Uses and use intensity within the district is intended to complement the traditional downtown. Section 2.01.03.25 Traditional Mixed Use—Historic-(TMU-H) This District includes those areas adjoining the City's traditional downtown that are also within the boundaries of the Historic District. This District places emphasis on and the preservation of historic resources and the character of the historic district as a part of a healthy city center. PART 2.02.07 LAND USES ALLOWED WITHIN ZONING DISTRICTS Section 2.02.07 Land Uses Allowed within the Traditional City Center The following sections describe the categories of uses, which apply within the traditional city center of the City of Zephyrhills. Section 2.02.07.01 Permitted Uses Permitted uses are allowed as a matter of right in each district as prescribed by Table 2.02.02 and in accordance with the standards and procedures set forth in this Code. Permitted uses are designated by the letter"P" in Table 2.02.02. Section 2.02.07.02 Provisional Uses Provisional uses are allowed as a matter of right in each district as prescribed in Table-2.02.02 provided that the use adheres to the standards prescribed for the zoning'district and is in accordance with supplemental standards and regulations as prescribed by Part 7.09.00 of the Land Development Code and Table 7.02 Development Standards for Traditional City Center. Provisional uses are designated by the letters "SPRC" in Table 2.02.02 designating review and approval by the Site Plan Review Committee as established in Article X of this Code.. Section 2.02.07.03 Provisional Use—Historic Appropriateness All uses within the designated Historic District or which are designated as a contributing,historic resource require review by the Historic Preservation Board as established by Article X of this : - of 14 Code and the issuance of a "certificate of appropriateness" under the provisions of Part 3.03.00 of the Land Development Code. Such uses must also meet the standards otherwise set forth in this Code. Provisional uses within the Historic District are designated by the letters "HPB" in Table 2.02.02. Section 2.02.07.04 Conditional Uses Conditional uses are not allowed as a matter of right in a zoning district, but which is allowed specifically prescribed by Part 7.09.00 of the Land Development Code and.otherwis&set forth in only upon a determination by the City Council that such use is in accordance with the standards this Code. Conditional uses are designated by the letter"C" in Table 2.02.02. Section 2.02.07.05 Accessory Uses and Structures within the Traditional City Center The provisions of Section 2.02.05 of the Land Development Code shall apply. Section 2.02.07.06 Temporary Uses within the Traditional City Center The provisions of Section 2.02.06 of the Land Development Code shall apply. SECTION 2. Repealer. Any ordinance, or part of any ordinance, in conflict herewith is hereby repealed to the extent of any conflict. SECTION 3. Severability. It is declared to be the intent of the City Council of the City of Zephyrhills, Florida, that if any section, subsection, sentence, clause, or provision of this Ordinance shall be declared invalid,the remainder of this Ordinance shall be construed as not having contained said section, subsection, sentence, clause, or provision and shall not be affected by such holding. SECTION 4. Inclusion in Code. The provisions of this Ordinance shall become and be made a part of the Land Development Code of the City of Zephyrhills, Florida. The sections of this Ordinance may be renumbered or re-lettered and the word"ordinance"may be changed to "section", "article" or such other appropriate word or phrase in order to accomplish such. SECTION 5. Effective Date. This Ordinance shall become effective upon passage on the third reading and signing by the Mayor.
