\� { T IIIIIIIiIIIII.IVIIIiIIIIVIIIVIIIVIIIVIIIIIII1IlliIII 2007069084 ORDINANCE NO. 974-07 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ZEPHYRHTLLS, FLORIDA, AMENDING SECTIONS 2.01.03.12, 11.07:00, AND 12.01.04.02(E), AMENDING TABLES 2.02.01 AND 7.01.01, AND AMENDING SECTION 7.09.00 TO ADD NEW SECTION 7.09.27, OF THE LAND DEVELOPMENT CODE; PROVIDING FOR SEVERABILITY, REPEALER,AND AN EFFECTIVE DATE. WHEREAS, the City Council has determined that it is in the City's interest to update the Land Development Code from time to time to assure that the Land Development Code adequately meets the needs of the City. NOW, THEREFORE, BE IT ORDAINED by the City Council' of the City of Zephyrhills,Florida, as follows: SECTION 1. Section 2.01.03.12, Land Use and Zoning Districts, of the Zephyrhills Land Development Code is hereby amended as follows: This category is established to identify areas of the City appropriate for professional services and related commercial activities, which produce minimal conflict with a residential environment. The gross floor area of a nonresidential building(s) shall not exceed 50% of the land area of the site upon which the building(s) is/are erected. Multi- family and uplex residential development in an OP district permitted as a Conditional Use and shall comply with all requirements of the R-4 district. SECTION 2. Section 12.01.04.02(E), Nonconforming Uses and Structures, of the Zephyrhills Land Development Code, is hereby deleted in its entirety and substantially rewritten as follows: E. Restoration A. Commercial Property. 1. A commercial building which is damaged by fire, explosion, or other casualty loss to the extent of 51% of its value (exclusive of walls below grade) as of the date of damage and as determined by fair market value of the building, and which does not comply with use or area requirements of this Code, shall not be restored except in conformity with the regulations for the use in which such building is located. a. A lawful nonconforming commercial building destroyed to the extent of less than 5-1% by fire, explosion, or other casualty loss or legally condemned, may be reconstructed and used for the same nonconforming use, provided that the reconstructed building shall not exceed in height, area, or volume as the building destroyed or condemned; and the building reconstruction shall be commenced within one year from the date the building was destroyed or condemned and shall be carried on without interruption. B. Residential Property. Ri. A single family residential building destroyed by a force mejeur may be rebuilt, provided that the reconstructed single-family residence does not exceed in height, area, or volume as the single-family residence, which was destroyed. Record and Return to: City Clerk's Office 5335 8th Street Zephyrhills, FL 33542 7 f £0 SECTION 5. 7.09.00, Supplemental Standards for Special Uses, shalf be amended'to add new section 7.09.27 as follows: 7.09.27 Model Homes Model homes are permitted provided: A. Construction plans shall identify the location and number of proposed•model centers and/or model homes per phase, not to exceed five. B. All required infrastructure for subject phase where model centers and/or model homes are proposed shall be in place prior to construction of the proposed model centers.=and/or model homes. C. A maximum number of five model homes are permitted per phase;- ; 4 D. A plot plan shall be submitted to the Building Department for issuance of a permit for each model center or model home.E. Proposed model centers shall provide an area designated for temporary parking. SECTION 6. Section 11.07.00, Stormwater Management Plan Review, of the Zephyrhills Land Development Code is hereby amended by adding Section B as follows: B. Drainage Plan Requirements 1. Applicant shall provide a signed and sealed plan that sets forth the Finished Floor Elevation(FFE). 2. Applicant shall provide the elevations 10 feet from the property line on the adjacent property. 3. Applicant shall set forth any retention needs and proposed.improvements, if any. 4. Applicant shall provide an Engineer's Site Approval Letter that states that the site, in its entirety was built according to plan. The letter shall be provided to the Building Department prior to the issuance of a certificate of occupancy, so that City may ensure that the property was graded correctly. 5. In the event that the applicant property owner's lot is part of an existing subdivision with a previously approved drainage plan, then they shall be exempt from the requirements of this section. SECTION 7. Repealer. Any ordinance or part of any ordinance, in conflict herewith is-hereby repealed to the extent of any conflict. SECTION 8. Severability. It is declared to be the intent of the City Council of the City of Zephyrhills, Florida, that if any section, subsection, sentence, clause, or provision of this Ordinance shall be declared invalid, the remainder of this Ordinance shall be construed as not having contained said section, subsection, sentence, clause, or provision and shall not be affected by such holding. SECTION 9. Inclusion in Code. The provisions of this Ordinance shall become and be made a part of the Land Development Code of the City of Zephyrhills, Florida. The sections of this Ordinance may be renumbered or re-lettered and the word "ordinance" may be changed to "section", "article" or such other appropriate word or phrase in order to accomplish such. SECTION 10. Effective Date. This Ordinance shall become effective upon passage on the third reading and signing by the Mayor.
