HomeMy WebLinkAbout979-07 Rezoning Downtown ]ggjiiiiiiiiiiiiiiiiiiiiiiiiiiir Rcpt.: 1120016 Rec: 18.50 ORDINANCE NO. 979-07 DS: 0.00 I T: 0.00 08/07/07 Dpty Clerk AN ORDINANCE OF THE CITY OF ZEPHYRHILLS, FLORIDA AMENDING THE ZEPHYRHILLS LAND DEVELOPMENT CODE TO CHANGE THE ZONING OF LAND HEREIN DESCRIBED FROM ZONING CATEGORY R-3 (RESIDENTIAL MEDIUM DENSITY), R-4 (RESIDENTIAL MULTI FAMILY), C-1 (NEIGHBORHOOD COMMERCIAL), C-2 (COMMUNITY COMMERICAL), OP (OFFICE PROFESSIONAL), AND RC (RECREATION CONSERVATION) TO ZONING CATAGORIES TCBD (TRADITIONAL CENTRAL BUSINESS DISTRICT), TCBD-H (TRADITIONAL CENTRAL BUSINESS DISTRICT- HISTORIC), TMU (TRADITIONAL MIXED USE ), AND TMU-H (TRADITIONAL MIXED USE - HISTORIC) IN ACCORDANCE WITH THE PROVISIONS OF SECTION 166.041, FLORIDA STATUTES; PROVIDING FOR CODIFICATION, CONFLICT, SEVERABILITY, AND AN EFFECTIVE DATE. WHEREAS, the City Council has been given authority by the State of Florida pursuant to Chapters 166 and 163, Florida Statutes, to rezone property within the City limits; and WHEREAS, due public notice of hearing on the proposed rezoning was given by the City Council on July 2 and July 12, 2007, as required by the Zephyrhills Land Development Code, as amended, and Chapters 163 and 166, Florida statutes; and _ WHEREAS, the Planning Commission, sitting as the Local Planning Agency, did°.hold a public hearing on the 8th day of May, 2007 to consider said proposed rezoning; and - WHEREAS, the City Council has determined that TCBD (TRADITIONAL CENTRAL BUSINESS DISTRICT), TCBD-H (TRADITIONAL CENTRAL BUSINESS DISTRICT- , HISTORIC), TMU (TRADITIONAL MIXED USE), AND TMU-H (TRADITIONAL MIXED .USE - HISTORIC) would promote the general welfare, and encourage proper develbpment within the City. NOW, THEREFORE, BE IT ENACTED AND ORDAINED BY THE CITY COUNCIL OF THE CITY OF ZEPHYRHILLS,FLORIDA,AS FOLLOWS: SECTION 1: The above Whereas clauses are hereby adopted and incorporated herein. SECTION 2: The Districts, collectively known as "Traditional City Center Zoning Districts, are as follows: JED PITTMRN PASCO COUNTY CLERK Symbol District OR BKO70 :5am PG � 2 TCBD Traditional Central Business District TCBD-H Traditional Central Business District- Historic TMU Traditional Mixed Use TMU-H Traditional Mixed Use—Historic SECTION 3: Zoning Map Said districts are bounded as shown on the map entitled "City of Zephyrhills, Florida Traditional City Center Zoning Districts", with all explanatory matter thereon, are hereby made a part of this Ordinance. SECTION 4: Interpretation of District Boundaries Where uncertainty exists as to the boundaries of any district shown on the Zoning Map, the following rules shall apply: A. Where such district boundaries are indicated as approximately following center lines of streets and alleys, lot line, or property lines, such lines shall be considered to be such boundaries. In unsubdivided property or where a district boundary divides a lot,the location of such boundary, unless the same is indicated by dimensions shown on the map, shall be determined by the use of the scale appearing on the Zoning Map. C. Where physical or cultural features existing on the ground are at variance with those shown on the Zoning Map, or in other circumstances not covered by the preceding rules,the Board of Zoning Adjustment shall interpret the district boundaries. SECTION 5: All ordinances or parts of ordinances in conflict herewith are hereby repealed to the extent of such conflict. SECTION 6: That if any section, sentence, clause, or phrase of this ordinance is held to be invalid or unconstitutional by a court of competent jurisdiction, then said holding shall in no way affect the validity of the remaining portions of this ordinance.
