ORDINANCE BY THE CITY COUNCIL OF ZEPHYRHILLS, FLORIDA
REQUIRING COMMERCIAL OR MUTI-FAMILY OCCUPANCIES TO
INSTALL AN AUTOMATIC FIRE SPRINKLER SYSTEM AND/OR
STANDPIPE SYSTEM.
WHEREAS, the City of Zephyrhills is charged with providing protection services to City
residents pursuant to Chapter 98-470, Laws of Florida; and
WHEREAS, Chapter 633, Florida Statutes, requires the City of Zephyrhills Fire Rescue to
enforce the Florida Fire Prevention Code and Life Safety Code as promulgated by the State Fire
Marshal's Office; and
WHEREAS, the City of Zephyrhills has determined that the health, safety, and welfare of the
citizens of Zephyrhills are promoted by requiring certain occupancies to have an automatic
sprinkler system and/or standpipe system; and
WHEREAS, by adopting this ordinance, the City of Zephyrhills, is furthering the growth
management goals .and objectives of their Comprehensive Plan and Land Development Code;
and
WHEREAS, the City Council finds.that it is appropriate to have automatic sprinkler systems
and/or standpipe system installed in certain occupancies to increase the level of fire protection to
allow for furthering growth; and
NOW, THEREFORE, BE IT ENACTED BY THE CITY COUNCIL OF THE CITY OF

SECTION 1: DEFINITIONS/ABBREVIATIONS: OR BK 7670 PG I
Authority Having Jurisdiction — An organization, office or individual responsible for enforcing
the requirements of a code or standard, or for approving equipment, materials, an installation, or
a procedure. (NFPA 1 Uniform Fire Code, 3.2.2).
Change of Use — In any building or structure, whether or not a physical alteration is needed, a
change from one use or occupancy classification to another that complies with NFPA 101 Life
Safety Code Section 4.6.7. (NFPA 1 Uniform Fire Code, 10.3.4.1).
Class I Standpipe System - a two and one half inch (2.5") hose connection for use by fire
departments and those trained in handling heavy fire streams.
Code — The referenced publication (Code, Standard or Statute) concerning the subject area
covered. The referenced Codes for this Ordinance shall be NFPA 1, Uniform Fire Code; NFPA
101,Life Safety Code; Florida Fire Prevention Code (Florida Statute, 633.0215).
Enclosed Courtyard — An open-air courtyard surrounded on all four sides by structures. Access
to such open area generally is through limited passageway such as breezeway, hallway or
corridor.
Existing Building — That which is already in existence on the date the current edition of the
Code(s)
go into effect. Built in Fire Protection measures such as firewall separation may
determine what is considered size of existing buildings. (Example: multiple occupancies of
similar type within one structure separated by rated firewall protection may be classified as
individual structures).
Existing Condition—Any situation, circumstance, or physical makeup of any structure, premise,
or process that was ongoing or in effect prior to the adoption of current edition of the Code.
Exit Discharge — That portion of a means of egress between the termination of an exit and a
public way. (Essentially, the exit out of a structure to the outside environment). (NFPA 1,
Uniform Fire Code, 3.3.93).

Firewall — Construction materials and method used to physically separate hazards within a
structure. Used to prevent the passage o flame from one area to another.
FDC — Fire Department Connection to either an automatic fire sprinkler system or standpipe
system.
Occupancy(use) classifications covered by this Ordinance:
Apartment Building — A building consisting of three (3) or more dwelling units with
independent cooking and bathroom facilities. (NFPA 1, Uniform Fire Code, 3.3.165.2).
NOTE: Hereafter, for the purposes of this Ordinance referred to as MULTI-FAMILY
occupancy and will encompass: apartment buildings,town houses, and condominiums.
Assemble Occupancy — (1) An occupancy used for the gathering of 50 or more persons
for deliberation, worship, entertainment, eating, drinking, amusement, awaiting
transportation, or similar uses; or (2) used as a special amusement building, regardless of
occupant load. (NFPA 1, Uniform Fire Code, 3.3.165.3).
Business Occupancy — An occupancy used for the transaction of business other than
mercantile. (NFPA 1, Uniform Fire Code, 3.3.165.5).
Mercantile Occupancy — An occupancy used for the display and sale of merchandise.
(NFPA 1, Uniform Fire Code, 3.3.165.17).
Storage Occupancy — An occupancy used for the storage or sheltering of goods,
merchandise,products, vehicles or animals. (NFPA 1, Uniform Fire Code, 3.3.165.25).
Occupant Load— The total number of persons that might occupy a building or portion thereof at
any one time. (NFPA 1, Uniform Fire Code, 3.3.166).
NFPA—National Fire Protection Association
Renovation—Any structural alteration, increase in square footage or change from one occupancy
type to another that would require physical alteration of the structure. Such renovation(s) require
the issuance of building permits. NOTE: cosmetic changes will not normally require the issuance
of a building permit and for the purpose of this Ordinance are not considered renovations.
SECTION 2: GENERAL:
All automatic sprinkler systems shall be installed in accordance with the Florida Fire Prevention
Code and their respective NFPA Standard, NFPA 13, Standard for the Installation of Sprinkler
Systems and 13R, Standard for the Installation of Sprinkler Systems in Residential Occupancies
up to and Including Four Stories in Height.
All standpipe systems shall be installed in accordance with the Florida Fire Prevention Code and
their respective NFPA Standard, NFPA 14, Standard for the Installation of Standpipe, Private
Fire Hydrants, and Hose Systems.
All automatic sprinkler systems installed in any building shall include an electronic supervision
containing automatic signal transmission that is continuously monitored and complies with
NFPA 72,National Fire Alarm Code.
SECTION 3: COMMERCIALIMULTI-FAMILY OCCUPANCIES REQUIRING
AUTOMATIC FIRE SPRINKLER SYSTEMS:
A. Some new commercial buildings shall have an automatic fire sprinkler-system with total
building coverage, unless modified by the Fire Marshal or designee. Such new buildings
requiring the installation of an.Automatic Fire Sprinkler System would be those that meet a—y of
the following conditions:

(1) Where the combined total occupant load could be two hundred (200) persons or
more, as calculated by NFPA 101, Chapter 7.
(2) Where assembly occupancy is located above or below the exit discharge,
regardless of the occupant load.
(3) In any and all areas below the level of exit discharge.
(4) In all buildings over five thousand (5,000) square feet of gross floor area of all
floors combined.
(5) _ In all buildings over two (2) stories in height regardless of gross floor area.
(6) Where the building occupancy is classified as health care, ambulatory health
care, residential board and care, detention and correctional.
(7) In buildings with storage piled twelve (12) feet or higher.
B. Existing (as defined in definitions above) Structures that will require Automatic Fire
Sprinkler Systems are those that have one or more of the following conditions present:
(1) Existing commercial buildings incorporating new additions or expansions that
results in an increase of total gross floor area that exceeds five thousand (5,000)
square feet. The Authority Having Jurisdiction will evaluate such increases in
gross floor space to determine if increases warrant installation of an approved
system. (Example: a 4800 square foot building who's owner increases floor space
by a mere 250 square foot addition.may not require a system unless occupancy
classification would require such, whereas a building that doubled its floor space
to over 5000 square feet would need an installed system).
(2) Existing buildings of five thousand (5,000) or more square feet of gross floor area
that are renovated to an extent, which involves fifty (50) percent or more of the
interior.
(3) Existing buildings of five thousand (5,000) or more square feet that undergoes a
change of the occupancy classification, to those defined in this Ordinance,
through renovation or other means.
(4) Existing Structures requiring the installation of a system may be granted a
reasonable grace period, no less than one year, as determined by the Authority
Having Jurisdiction, to install the required system so as to not create undue
hardship or financial impact.
NOTE: SHOULD ANY OF THE ABOVE EXISTING BUILDINGS BE BUILT AS
NEW AT THE TIME ANY OF THE ABOVE TAKES PLACE THEY WOULD HAVE
REQUIRED THE INSTALLATION OF AN AUTOMATIC FIRE SPRINKLER
SYSTEM.
D. In all new apartments buildings, town houses or condominiums consisting of 4 or more
units shall require the installation of an Automatic Fire Sprinkler System.
E. FDC's will be located within 150 feet of a functioning, duly inspected, adequately
supplied fire hydrant installed to current American Water Works Association (AWWA)
standards. FDC's will be clearly marked with six (6) inch letters and/or numbers, visible at day
or night.
SECTION 4: COMMERCIAL/MULTI-FAMILY OCCUPANCIES - RE UIRING
STANDPIPE SYSTEMS:
A. New buildings shall be equipped with a Class I standpipe system where any of the
following exists,unless modified by the Fire Marshal or designee:

(1) More than two (2) stories above grade.
(2) More than thirty-five (35) feet above grade.
(3) More than one story below grade.

(5) All new parking garages.
(6) In buildings with storage piled twelve (12) feet or higher.
(7) Buildings protected by an automatic sprinkler system, with an enclosed courtyard
that has limited fire rescue access for firefighting purposes.
B. FDC's will be located within 150 feet of a functioning, duly inspected, adequately

standards. FDC's will be clearly marked with six (6) inch letters and/or numbers, visible at day
or night.
SECTION 5: MAINTENANCE AND TESTING:
All automatic fire sprinkler systems and standpipe systems shall be inspected, tested, and
maintained in accordance with NFPA 25, Standard for inspection, Testing, and Maintenance of
Water-Based FIRE Protection Systems.
SECTION 6: REPEALER:
Any ordinance or part of any ordinance, in conflict herewith is hereby repealed to the extent of
any conflict.
SECTION 7: SEVERABILITY:
It is declared to be the intent of the City Council of the City of Zephyrhills, Florida, that if any
section, subsection, sentence, clause, or provision of this Ordinance shall be declared invalid, the
remainder of this Ordinance shall be construed as not having contained said section, subsection,
sentence, clause, or provision and shall not be affected by such holding.
SECTION 8: EFFECTIVE DATE:
This ordinance shall become effective upon passage on the third reading and signing by the
Mayor, and pursuant to Florida Fire Prevention Code and Life Safety Code.
