Rcpt: 1161528 Rec: 86.50 ORDINANCE NO. 998-08 DS: 0.00 I T: 0.00 02/18/08 Dpty lerk AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ZEPHYRHILLS, FLORIDA, AMENDING ARTICLE V, SECTIONS 5.04.00, 5.04.01, and 7.03.01 OF THE LAND DEVELOPMENT CODE REGARDING TRANSPORTATION SYSTEM LEVEL OF SERVICE, DETERMINATION OF PROJECT IMPACT, AND TRAFFIC STUDY REQUIRMENTS; PROVIDING FOR SEVERABILITY, REPEALER, AND AN EFFECTIVE DATE. VHEREAS, Sections 5.04.00, 5.04.01 and 7.03.01 of the Land Development Code deal wit t ansportation levels of service, methods for determining a projects impact and requirement fo t e traffic study; and WHEREAS, the City Council has determined that it is necessary and in the best interest of the :ity to amend the Land Development Code as follows: , OW, THEREFORE, BE IT ORDAINED by the City Council of the City of Zephyrhills Florida, as follows: " JED PITTMAN PASCO COUNTY &LERK 02/18/08 1�:11pm 1 of 10 OR BK 7763 PG 1477 ECTION 1. Article V, Section 5.04.00, Transportation System Level of Service, of th Zephyrhills Land Development Code is hereby amended as follows: The Traffic Circulation Element of the City of Zephyrhills Comprehensive Plan contain he following level of service requirements for roadways in the City: Type of Facility Peak Hour Level of Service Local Streets LOS "D"Peak Hour Minor and Major Arterials LOS "D"Peak Hour ECTION 2. Article V, Adequate Public Facilities, Section 5.04.01, Determination of Proje t Impact, of the Zephyrhills Land Development Code is hereby amended as follows: An application for a comprehensive plan amendment, a rezoning or site plan approval of proposed development shall determine the impact of the project by the following procedures: A traffic impact analysis shall be prepared by the developer or his designee that includes projection of the gross daily trips to be generated by the project and the distribution of the trips onto adjacent streets. Institute of Traffic Engineers trip generation rates or another approved source shall be used as the basis for trip generation calculations. A development may be defined as de minimus if the development is anticipated tp enerate less than 1,200 gross daily trips. No additional concurrency analysis will be required or de minimus developments. A traffic study is required if the development is anticipated to generate more than 1,200 gross daily trips. If a traffic study is required, the traffic study analysis should be conducted following the procedures defined in Table 1: Traffic Study Requirements/Guidelines and Tabl 2: Traffic Study Assumptions. Both de minimus projects and projects ,requiring a traffic study shall provide, at inimum, the following Level of Service calculations at each project access point during th p.m. peak hour; 1. A determination of need and length of turn lanes at project driveways consistent with the City of Zephyrhills's Land Development Code; and 2. A determination of need for traffic signals or other traffic control devices at project driveways. SECTION 3. Article VII, Design Standards and Improvement Requirements, Section 7.03.01, Traffic Study Requirements, of the Zephyrhills Land Development Code is hereby amended as follows: A. Proposed development projects are required to provide plans of their development projects to the Site Plan Review Committee, including a traffic study in accordance with 5.04.01 to determine the impact on the transportation system. B. Projects determined to be de minimus, are required to provide, at a minimum, the following information. 1. Level of Service calculations at each project access point during the p.m. peak hour; 2. A determination of need and length of turn lanes at project driveways consistent with the City of Zephyrhills Land Development Code; and 3. A de termination of need for traffic signals or other traffic control devices at project driveways. C. For projects where a traffic study is required, the traffic study shall be prepared by the developer or his designee in accordance with Table 1: Traffic Study Requirements/Guidelines and Table 2: Traffic Study Assumptions, and provide the following information: 1. Meth dology Statement; 2.- Study Area;- - — 3 Analysis Period; 4. Project Traffic; 5. Existing Conditions; 6. Background Conditions; 7. Vested Improvements; 8. Capacity Analysis; and 9. Trans osition Mitigation. D. For projects within the City that front a County/State Road, a pre-application meeting with Pasco County is required to determine Pasco County Traffic Study and review process requirements. Traffic study requirements should be sufficient to address both the City concurrency traffic study requirements and the County/State substandard road and access management requirements. All traffic analysis shall be conducted using generally accepted traffic analysis standards and guidelines. SECTION 4. Table 1: Traffic Study Requirements/Guidelines, and Table 2: Traffic Study Assumptions contained within the Zephyrhills Land Development Code is hereby amended as follows: As attached in Exhibit A and B SECTION 5. Severability. t is declared to be the intent of the City Council of the City of Zephyrhills, Florida, that if an ection, subsection, sentence, clause, or provision of this Ordinance shall be declared invalid, the emainder of this Ordinance shall be construed as not having contained said section, subsection entence, clause, or provision and shall not be affected by such holding. ECTION 7. Inclusion in Code. he provisions of this Ordinance shall become and be made a part of the Land Development ode of the City of Zephyrhills, Florida.
