ORDINANCE NO.: 1005-08
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
ZEPHYRHILLS, FLORIDA AMENDING ARTICLE VII, SECTION
7.09.03 OF THE LAND DEVELOPMENT CODE REGARDING
ALCOHOLIC BEVERAGE SALES; PROVIDING FOR SEVERABILITY,

HEREAS, Section 7.09.03 of the Land Development Code defines the alcohol sales setbacks
r quired by the City of Zephyrhills; and
HEREAS, the City Council has determined that it would be consistent with and promote the
ealth, safety and wellbeing of the community to amend the alcohol setback requirements.
OW, THEREFORE, BE IT ORDAINED by the City Council of the City of Zephyrhills,
Florida, as follows:
ECTION 1. Article VII, Section 7.09.03, Alcoholic Beverage Sales, of the Zephyrhills Land
evelopment Code is hereby amended as follows:
Alcoholic beverage sales are controlled by all appropriate City, State, and Federal Regulations.
o sale of alcoholic beverages may occur within 300 feet of any school, church, or other
r ligious institution as measured from the vendor's principal structure to the nearest principal
s ructure or outdoor active use area (excluding parking) of the school, church, or other religious
i stitution.
he sale of alcoholic beverages,for on premise consumption only, is permitted within 300 feet of
Pa school, church, or other religious institution, provided that the seating capacity of the
e tablishment is not less than twenty five (25) and wherein the combined gross sales of the
b isiness operation is more than 51% attributed to the sale of food and non-alcoholic beverages.
e City may, during the Establishment's normal business hours at the official location of the
stablishment's books and records, audit the records of the Establishment for the purpose of
a certaining whether not less than twenty five (25) and wherein the combined gross sales of the

o sale of alcoholic beverages may occur within 500 feet of an adult entertainment
e tablishment.
S CTION 2. Repealer.
Any ordinance, or part of any ordinance, in conflict herewith is hereby repealed to the extent of
y conflict.
S CTION 3. Severability.
It is declared to be the intent of the City Council of the City of Zephyrhills, Florida, that if any
s ction, subsection, sentence, clause, or provision of this Ordinance shall be declared invalid, the
remainder of this Ordinance shall be construed as not having contained said section, subsection,
s ntence, clause, or provision and shall not be affected by such holding.
SECTION 4. Inclusion in Code.
T e provisions of this Ordinance shall become and be made a part of the Land Development
C de of the City of Zephyrhills, Florida. The sections of this Ordinance may be renumbered or
re lettered and the word "ordinance" may be changed to "section", "article" or such other
a propriate word or phrase in order to accomplish such.

SECTION 5. Effective Date.
This Ordinance shall become effective upon passage on the third reading and signing by the
Mayor.
The foregoing Ordinance No. 1005-08 was read and passed on the first reading in an open and
regular n1 of the,City-Council of the City of Zephyrhills, Florida, on this 25th day of
February, 20081
