HomeMy WebLinkAbout937-05 Amend Minimum Standards at Airport ORDINANCE NO.: 937-05 AN ORDINANCE BY THE CITY COUNCIL OF ZEPHYRHILLS, FLORIDA AMENDING ORDINANCE NO. 849-03 ADOPTING NEW MINIMUM STANDARDS FOR PERSONAL PORTABLE HANGARS LOCATED AT THE ZEPHYRHILLS AIRPORT; AMENDING THE DEFINITION OF RENTER IN THE MINIMUM STANDARDS TO PROVIDE FOR RENTAL OF PERSONAL PORTABLE HANGARS; PROVIDING FOR CODIFICATION, REPEALER, SEVERABILITY AND AN EFFECTIVE DATE. JHEREAS, on May 12, 2003, the City Council adopted new minimum standards -foi commercial aeronautical activities of the City of Zephyrhills Municipal Airport; and EREAS, many of these standards were similar or identical to certain recommended standards applied to federally obligated airports by the FAA; and HEREAS, in order to enhance the uniform application of these minimum standards an ddress some new recent aircraft-related uses, it h s become necessary to amend the Definitions ection of the Minimum Standards. OW, THEREFORE, BE IT ORDAINED by the City Council of the City of Zephyrhills lorida as follows: ECTION 1. Ordinance No. 849-03, Composite Exhibit "A", Definitions, is hereby amended'a Ilows: Renter—A person or organization that holds, or has the use of, property by payment of rent as a Rental Agreement for specified or unspecified period of time. Renter shall not hold interest, ownership responsibilities of the said property and/or facilities. With the exception of persons renting. a personal portable hangar, a renter shall not be held liable for lease related requirements such as tax assessments, insurance, etc. Any renter performing commercial aeronautic activity shall obtain approval of its status from the Airport Advisory Board. Any such renter shall within sixty (60) days, of approval by the Airport Advisory Board, provide to that Board all of the requirements contained in Lease Application Process and Proposal Requirements found in the Minimum Standards for Aeronautical Activities of the.Zephyrhills Airport. ECTION 2. Repealer. 4ny and all ordinances or minimum standards ir conflict herewith are hereby repealed to the extent of such conflict. ECTION 3. Codification. It is the intent of the City Council that the provisions of this ordinance shall be codified as and ___ _ ecome part,of the_Minimum Standards. _ ECTION 4. Severability. It is declared to be the intent of the City Council of the City of Zephyrhills, Florida, that if an ection, subsection, sentence, clause, or provision of this Ordinance is held invalid,the remainde f the Ordinance shall be construed as not having contained said section, subsection, sentence lause, or provision, and shall not be affected by such holding. ECTION 5. Effective Date. his ordinance shall become effective upon passage on the second reading and signing by the Mayor.
