PASCO C NTY CLERK 11/22/05 11:25am X of 2 OR BK 6707 PG 1 91 WHEREAS, Chapters 166 and 163, Florida Statutes, authorize and req 're the City Council of the City of Zephyrhills to prepare and enforce a Comprehensive.Plan for the development of the City; and �HEREAS, the City of Zephyrhills adopted its Comprehensive Plan on May 22, 1989; and ;t— Cqe HEREAS, on August 22, 2005, the City Council conducted a public hearing and authorized the transmittal of the attached amendments to the adopted Future Land U� e Map of the Comprehensive Plan to the Florida Department.of Community Affairs ( DCA) to obtain review and comment on the amendments; and WHEREAS, an amendment from County ROR (Retail, Office, Residential) aid RES-3 (3 di.x/ga) to RU (Residential Urban) on property owned by Lucille Wheeleris specifically described and attached hereto as Exhibit "A"; and WHEREAS, an amendment from County RES-6 (6 du/ga) to RS':, (Residential Suburban) on property owned by Siblings, L.L.C. is specifically described and attached h c reto as Exhibit "B"; and W EREAS, on November 14, 2005, the City Council conducted an adoption public hearing on the proposed plan amendments with due public notice provided pursuant to Section 163.3184, Florida Statutes, and has considered all comments received during the public hearing. ,, cn N iQW, THEREFORE, BE IT ORDAINED by the City Council of the City of Zephyrhills, Florida, as follows: o SECTION 1. Adoption. a The City Council of the City of Zephyrhills hereby adopts the 'amendments .to the 2 Future Land Use Map of the Comprehensive Plan attached hereto as Exhibits "A" and 1D and incorporated herein. Should the FDCA find these amendments not in compliance, the applicants agree to defend 'the City and pay all fees and costs associated with the defense thereof, including the retention of attorneys and experts. 0 NM SECTION 2. Repealer. W oo-0 R �H provisions of the City of Zephyrhills Comprehensive Plan as amended, in conflict 4heewith are hereby repealed. S ECTION 3. A certified copy of this Ordinance shall become'effective within twenty-one (21) days if no appeal is filed. No development orders, development permits, or land uses dependent on this amendment may be issued or commenced before it has become effective. If.<,a final •order of noncompliance is issued by the Administrative Commission; this amendment may nevertheless be made effective by adoption of a resolution affirming its effective status. A copy of such resolution shall be sent to the Florida•Department: of Community Affairs, Bureau of Local Planning, 2555 Shumard Oak Boulevard, Tallahassee, Florida 32399-2100.
