AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF
ZEPHYRHILLS, FLORIDA, AMENDING ORDINANCE 417, CODIFIED AS
SECTIONS 96.40 THROUGH 96.43 OF THE ZEPHYRIILLLS CODE OF
ORDINANCES, REGARDING STREET] NAMING AND RENAMING, TO
PROVIDE SPECIFIC ADDITIONAL REQUIREMENTS FOR RENAMING
EXISTING STREETS; PROVIDING PROCEDURES FOR APPLICATIONS
FOR STREET NAMES, SUITABILITY OF CHANGES, PROVIDING FOR
CODIFICATION, REPEALER, SEVERABILITY AND AN EFFECTIVE
DATE.
WHEREAS, in April 1987, the City of Zephyrhills adopted Ordinance No. 417 which was codified
Sections 96.40 through 96.43 of the Zephyrhills Code o Ordinances;\THEREAS,Ordinance No.417 provides methods for application by citizens for the naming or renamin
of streets within the City limits;and
WHEREAS,the unrestricted renaming of existing streets within the City causes confusion and discontent
d is costly to residents and local businesses who must change addresses on maps,financial documents

REAS,after much consideration,the Zephyrhills(City Council desires to amend Ordinance No.417

OW, THEREFORE, BE IT ORDAINED by the City Council of the City of Zephyrhills, Florida,

Ordinances is hereby amended and substantially rewritten as follows:
ection A. Street Name Required:
1 public and private streets within the City shall receive names from the City Council. All streets whit
p esently are named by City map or other municipal instrument shall remain the same unlesschanged by
City Council. This instrument provides for two methods of changing street names: 1) through th
a thority of City Council and 2)through citizen initiative.

1 For the purpose of this ordinance,the general term of"streets"shall also be applied to avenues,
lanes, courts, ways and other generic or descriptive street identifications. The general policy is
that the names of streets shall not be changed without legitimate reason and review.
2 The renaming of a specific street may be considered when renaming would generally improv
the City's administration of essential services or would be in the public's best interest.
Prior to consideration of a name change by City Council, notice must be carried out,
including advertising the proposed name change in the form of a display advertisement,run in a
local newspaper of general circulation,for four(4)weeks and giving affected parties an opportunity
to be heard by Council.The ad shall identify the change of the street name,date(s)of a public hearing
and comment schedule and a map location. It shall be noted that residents residing or abutting a street
proposed for renaming shall have a say in the process but are not the only stakeholders in the process.
4 Applications for street name or change of street name shall be accompanied by a fee established by
resolution of the City Council, which fee shall reflect the actual cost of providing the review,
materials and any installation costs.
5 Numerical named streets and/or those with alphabetical listings shall not be changed.
6 Honorarium street names may be considered.
S etion C. Names to be Avoided:
1. Street names being a duplicate of an existing street in the City of Zephyrhills or in the
surrounding area should be prohibited.

2. Similar sounding names should be avoided:
3. Discriminatory or derogatory names, from the point of view of race, sex, color, creed,political
affiliation or other social factors are prohibited.
4. Names for public streets that could be construed as advertising a particular business shall be
avoided.
Section D. Applications and Street Type Designations:
1. Applications by citizens or initiatives by City Council to rename a street shall follow procedures as
mandated in the City's Land Development Code,Chapter 7,Section 7.03.03.07,as amended.
2. Street Type Designations for new streets or renamed streets shall follow the designations as established
in the City's Land Development Code,Chapter 7,Section 7.03.03.07,as amended.
SECTION 2. All ordinances or code provisions in conflict with this ordinance,including but not limited to
Ordinance No.417 and Sections 96.40 through 96.43 of the Code of Ordinances,are hereby repealed.
SECTION 3. IT IS THE INTENTION OF THE City Council that this ordinance be subsequently codified
in the Zephyrhills Code of Ordinances.
SECTION 4. Severability.
It is declared to be the intent of the City Council of the City of Zephyrhills, Florida that if any section,
subsection, sentence, clause, or provision of this ordinance shall be declared invalid, the remainder of the
ordinance shall be construed as not having contained said section,subsection,sentence,clause,or provision,
and shall not be affected by ch,holding.
SECTION 5. Effective Date.
This ordinance shall become effective upon passage of the third reading and signing by the Mayor.
