(4 RAIL) �c ; PI- I'MRN, PA5CO COUNTY CLERK it?/1 / i 10:331am` :. 1. f Or, 13K 7c1PGI EREAS, 4 RAIL, LLC, the owner of land hereinafter described in Section 2 below, did petition in November, 2005 for re-designation of said land; and HEREAS, the City Council of Zephyrhills,-Florida, has been given authority by the State o Florida pursuant to Chapter 163, Florida Statutes, to amend the Future Land Use Map of the ity's territorial boundaries upon receipt of written consent of the land owners, together with the a proval of the City Council of said Future Land Use Map amendment duly expressed by 9rdinance; and WHEREAS, the City Council has been given authority by the State of Florida, pursuant to chapters 166 and 1.63, Florida Statutes, to rezone the property within the City limits upon receipt o written consent of the land owner,together with approval of the City Council of said rezoning ly expressed by ordinance; and REAS, due public notice of hearing on the proposed rezoning and future land use map endment was given by the City Council on June 17, 2006 and July 1, 2006, as required by the ity's Land Development Code and Chapter 166, Florida Statutes; and EREAS, the Planning Commission, did hold a public hearing on January 10, 2006 , to c nsider said proposed rezoning and future land use map amendment; and HEREAS, the City Council has determined that the IN, Industrial, future land use designation, d the LI, Light Industrial zoning category would be appropriate, would.promote the general elfare, and encourage proper development within the City. The applicant and-the City shall coordinate with property owners to the north of the subject property to discuss potential interconnections to the north/CR 54. 2. Special attention shall be paid during the development review process to maximize buffering along the southern and western boundary lines that are in the vicinity of residential uses. Staff also recommends that future development plans should maximize efforts to locate structures/activities a maximum distance from the southern/western boundary lines. 3. The developer acknowledges that any provisions of the City of Zephyrhills Ordinances and rezoning conditions of approval not specifically waived shall be in full force and effect, including all applicable impact fees. Section 3: All ordinances or parts of ordinances in conflict herewith are hereby repealed to the extent of such conflict. Section 4: That if any section, sentence, clause, or phrase of this ordinance is held to be invalid or unconstitutional by a court of competent jurisdiction, then said holding shall in no way affect the validity of the remaining portions of this ordinance. Section 5: This ordinance shall take effect as provided in the City Charter and Chapter 166, Florida Statutes.
