AN ORDINANCE OF THE CITY OF ZEPHYRHILLS, FLORIDA
APPROVING A SMALL SCALE FUTURE LAND USE MAP
AMENDMENT TO THE CITY'S COMPREHENSIVE PLAN; CHANGING
THE FUTURE LAND USE MAP DESIGNATION FOR THE TERRITORY
HEREINAFTER DESCRIBED FROM COUNTY FUTURE LAND USE
MAP DESIGNATION RES-6 (6 du/ga) TO CITY DESIGNATION RU,
RESIDENTIAL URBAN, CONSISTENT WITH THE GOALS,
OBJECTIVES, AND POLICIES OF THE ADOPTED COMPREHENSIVE
PLAN, AS REQUIRED BY THE GROWTH MANAGEMENT ACT OF
1985; PROVIDING FOR CODIFICATION, CONFLICT, SEVERABILITY,

HEREAS, MD PROPERTIES, LLC, the owner of land hereinafter described in Section 1
elow, did petition in December, 2005 for re-designation of said land; and
\kJHEREAS, the City Council of Zephyrhills, Florida, has been given authority by the State o
Florida pursuant to Chapter 163, Florida Statutes to amend the Future Land Use Map of th
ity's territorial boundaries upon receipt of written consent of the land owners, together with th
proval of the City Council of said Future Land Use Map amendment duly expressed b
rdinance; and -
EREAS, due public notice of hearing on the proposed future land use map-amendment wa
iven by the City Council on February 16 and February 23, 2006, as required by the City's Lan
evelopment Code and Chapter 166, Florida Statutes; and
HEREAS, the Planning Commission, did hold a public hearing on January 10, 2006 , t
onsider said proposed future land use map amendment; and
HEREAS, the City Council has determined that the RU, Residential Urban, future land us
esignation would be appropriate, would promote the general welfare, and encourage prope
evelopment within the City.
OW, THEREFORE, BE IT ENACTED AND ORDAINED BY THE CITY COUNCIL O
EPHYRHILLS, FLORIDA, AS FOLLOWS:
ection 1: The above Whereas clauses are hereby adopted and incorporated herein.
ection 2: The following described lands, lying and being situated in Pasco County,to wit:
EGAL DESCRIPTION: TRACT 19, ZEPHYRHILLS COLONY COMPANY LANDS
SECTION 15, TOWNSHIP 26 SOUTH, RANGE 21 EAST, AS PER PLAT THEREO
CORDED IN PLAT BOOK 1, PAGE 55 PUBLIC RECORDS OF PASCO COUNTY
LORIDA.
ONTAINING 5.12 ACRES,MORE OR LESS.
ARCEL I.D.NO.: 15-26-21-0030,01900-0010
i hereby designated on the Future Land Use Map and included within the boundaries o
ephyrhills, Florida, subject to the following conditions:
1. The applicant/developer must comply with the Pasco County Access Managemen
Ordinance including all required off-site transportation improvements and acquisition o
a right-of-way use permit prior to connection to Court Street.
2. The applicant/developer shall provide a substantial perimeter buffering to reduce noise
and provide details on all site/construction plans to minimize overflow lighting.

3. Gopher tortoises may reside on site and must be addressed with all applicable permitting
agencies prior to any construction work. Copies of all permit applications and permits
issued must be provided to the City.
4. The entrance connecting Shaw Drive shall be used for emergency purposes only and shall
be equipped with an electric gate with code.
Section 3: All ordinances or parts of ordinances in conflict herewith are hereby repealed to the
extent of such conflict.
Section 4: That if any section, sentence, clause, or phrase of this ordinance is held to be invalid
or unconstitutional'by a court of competent jurisdiction, then said holding shall in no way affect
the validity of the remaining portions of this ordinance.
Section 5: This ordinance shall take effect as provided in the City Charter and Chapter 166,
Florida Statutes.
