Adoption. T e City Council of the City of Zephyrhills hereby adopts the amendments to the Future Land se Map of the Comprehensive Plan attached hereto as Ordinance 951-06 and Ordinance 949-06 d incorporated herein. Should the FDCA find these amendments not in compliance, the a plicants agree to defend the City and pay all fees and costs associated with the defense thereof, ii cluding the retention of attorneys and experts. All provisions of the City of Zephyrhills Comprehensive Plan as amended, in conflict herewith are hereby repealed. SECTION 3. Severability. If any section, subsection, sentence, clause, or provision of this Ordinance is held invalid or unconstitutional by a court of competent jurisdiction, then the said holding shall in no way affect the validity of the remaining portions of this Ordinance having contained such section, subsection, sentence, clause, or provision, and shall not be affected by such holding. SECTION 4. Effective Date. A certified copy of this Ordinance shall become effective within twenty-one (21) days if no appeal is filed. No development orders, development permits, or land uses dependent on this amendment may be issued or commenced before it has become effective. If a final order of noncompliance is issued by the Administrative Commission, this amendment may nevertheless be made effective by adoption of a resolution affirming its effective status. A copy of such resolution shall be sent to the Florida Department of Community Affairs, Bureau of Local Planning, 2555 Shumard Oak Boulevard, Tallahassee, Florida 32399-2100. The Notice of Transmittal to the Department of Community Affairs was approved following a public hearin held on March 13, 2006 in an open and regular meeting of the City Council of the City of Zephy ills,Florida, on this 13th day of March, 2006.
