HomeMy WebLinkAbout949-06 Attachment B ~ 4R 5K 1 PG 904 ATTACHMENT "B" 13 of F, ORDINANCE NO.: 949-06 AN ORDINANCE OF THE CITY J OF ZEPHYRHILLS, FLORIDA APPROVING A LARGE SCALE 'i FUTURE LAND USE MAP AMENDMENT TO THE CITY'S COMPREHENSIVE PLAN; CHANGING THE FUTURE LAND USE MAP DESIGNATION FOR THE TERRITORY HEREINAFTER DESCRIBED FROM CITY FUTURE LAND USE AGRICULTURAL AND COUNTY I FUTURE LAND USE MAP DESIGNATIONS IL, LIGHT INDUSTRIAL, AND RES-3 (3 du/ga) TO CITY DESIGNATION IN, INDUSTRIAL, CONSISTENT WITH THE GOALS, OBJECTIVES, AND POLICIES OF THE ADOPTED COMPREHENSIVE PLAN, AS REQUIRED BY THE GROWTH MANAGEMENT ACT OF 1985;.AMENDING THE ZEPHYRHILLS LAND _ _ __ DEVELOPMENT CODE TO CHANGE THE ZONING ON LAND HEREINAFTER DESCRIBED FROM CITY ZONING CATEGORY ER, ESTATE RESIDENTIAL, AND COUNTY ZONING CATEGORY AC, AGRICULTURE, TO CITY ZONING CATEGORY LI, LIGHT INDUSTRIAL, IN ACCORDANCE WITH THE PROVISIONS OF SECTION 166.041, FLORIDA STATUTES; PROVIDING FOR CODIFICATION, CONFLICT SEVERABILITY, AND AN EFFECTIVE DATE. (4 RAIL) EREAS, 4 RAIL, LLC, the owner of land hereinafter described in Section 2 below, did petition in November, 2005 for re-designation of said land; and WHEREAS, the City Council of Zephyrhills, Florida, has been given authority by the State of Fl rida pursuant to Chapter 163, Florida Statutes, 'to amend the Future Land Use Map of the City's territorial boundaries upon receipt of written consent of the land owners, together with the approval of the City Council of said Future Land Use Map amendment duly expressed by O dinance; and EREAS, the City Council has been given authority by the State of Florida, pursuant to Chapters 166 and 163, Florida Statutes, to rezone the property within the City limits ,upon r6.ceipt of written consent of the land owner, together with approval of the City Council of said rezoning du y expressed by ordinance; and EREAS, due public notice of hearing on the proposed rezoning and future land use map an endment was given by the City Council on June 1]7, 2006 and July 1, 2006, as;required by.the Ci y's Land Development Code and Chapter 166, Florida Statutes; and ISetion IEREAS, the Planning Commission, did hold a public hearing on January 10; 2006 , to ider said proposed rezoning and future land use map amendment; and EREAS, the City Council has determined that the IN, Industrial, future land use designation, the LI, Light Industrial zoning category would The appropriate, would promote the general are, and encourage proper development within the City. The applicant and.the City shall coordinate with property owners to the north of the subject property to discuss potential interconnections to the north/CR 54. 2. Special attention shall be paid during the development review process to maximize buffering along the southern and western boundary lines that are in the vicinity of residential uses. Staff also recommends that future development plans should maximize efforts to locate structures/activities a maximum distance from the southern/western boundary lines. 3. The developer acknowledges that any provisions of the City of Zephyrhills Ordinances and rezoning conditions of approval not specifically waived shall be in full force and effect, including all applicable impact fees. Section 3: All ordinances or parts of ordinances in conflict herewith are hereby repealed to the extent of such conflict. Section 4: That if any section, sentence, clause, or phrase of this ordinance is held to be invalid or unconstitutional by a court of competent jurisdiction, then said holding shall in no way affect the validity of the remaining portions of this ordinance. Section 5: This ordinance shall take effect as provided in the City Charter and Chapter 166, Florida Statutes. The foregoing Ordinance No. 949-06 was read and passed on the first reading in an open and regular meeting of the"City Council of the City of Zephyrhills, Florida, on this 13th day of February, 2006.
