AN ORDINANCE OF THE CITY OF ZEPHYRHILLS, FLORIDA
AMENDING THE ZEPHYRHE LS LAND DEVELOPMENT CODE TO
CHANGE THE ZONING ON LAND HEREINAFTER DESCRIBED FROM
COUNTY ZONING CATEGORY AR(AGRICULTURAL RESIDENTIAL)
TO CITY ZONING CATEGORY R-4 (MULTI-FAMILY RESIDENTIAL)
IN ACCORDANCE WITH THE PROVISIONS OF SECTION 166.041,
FLORIDA STATUTES; PROVIDING FOR CODIFICATION, CONFLICT,
SEVERABILITY,AND AN EFFECTIVE DATE.

HEREAS, ACME Development Corp., the owner of land hereinafter described in Section 2
b low, did petition on the 26rd day of June, 2006 for rezoning of said land; and
HEREAS, the City Council has been given authority by the State of Florida pursuant to
C lapters 166 and 163, Florida Statutes, to rezone property within the City limits upon receipt of
itten consent of the land. owner, together with the approval of the City Council of said
rl zoning duly expressed by Ordinance; and
EREAS, due public notice of hearing on the' proposed rezoning was given by the City
C uncil on September 2, 2006 and September 16, 2006, as required by the Zephyrhills Land
D velopment Code, as amended, and Chapters 163 tnd 166, Florida Statutes; and
HEREAS, the Planning Commission, sitting as the Local Planning Agency, did hold'a public
h aring on August 8, 2006 to consider said proposed rezoning; and
HEREAS, the City Council has determined that the R-4 (Multi-Family Residential) zoning
ca egory would be appropriate, would promote the general welfare, and encourage proper
d velopment within the City.
N W, THEREFORE, BE- IT ENACTED AND ORDAINED BY THE CITY COUNCIL OF
Z PHYRHILLS, FLORIDA, AS FOLLOWS:
S ction 1: The above Whereas clauses are hereby adopted and incorporated herein.
S ction 2: The following described lands, lying and being situated in Pasco-County,to wit:

is iereby rezoned and included within the boundaries of the City of Zephyrhills, Florida subject
to he following conditions:
1. Tree removal shall corhply with Section 7.06!00 of the City's Land Development Code.
2. Future development shall comply with the basins of special concern city ordinance.
3. All environmental issues and permits shall be addressed prior to the commencement of
construction.
4. In the event that Towphomes are developed, such development shall comply with the
City's adopted townhouse development stand)rds.
5. Required sidewalk and bike lane improvements shall be completed prior to the approval
of future site plan/final plat.

6. The previously submitted traffic study/analysis shall be reviewed by the City's engineer
of record to assess levels of service/required roadway improvements.
7. The developer shall dbtain all County ROW use permits from the appropriate County
entities to determine ROW needs and prior to access/driveway connection to Ft. King
Rd., and shall comply with all provisions of the Pasco County access management
ordinance as applicable.
8. The developer/applicant acknowledges that any provisions of the City of Zephyrhills
ordinances and rezoning conditions of approval not specially waived shall be in full force
and effect, including all impact fees, drainage and landscaping ordinances.
9. The future developer/builder shall investigate opportunities to provide a cross access
connection with the property to the south along the-western-boundary-to connect With -
Eiland Blvd.
Section 3: All ordinances or parts of ordinances in conflict herewith are hereby repealed to the
extent of such conflict.
Section 4: That if any section, sentence, clause, or phrase of this ordinance is held to be invalid
or unconstitutional by a court of competent jurisdiction, then said holding shall in no way affect
the validity of the remaining portions of this ordinance.
Section 5: This ordinance shall take effect as provided in the City Charter and Chapter 163,
