AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
ZEPHYRHILLS, .FLORIDA AMENDING ORDINANCE NO.
659, SECTIONS 71-20 THROUGH 71-29 OF THE
-ZEPHYRHILLIS CODE OF.ORDINANCES; PROVIDING FOR
REGULATION OF PARKING OF SEMI TRACTORS;
TRUCKS, TRAILERS, COMMERCIAL VEHICLES AND
RECREATIONAL VEHICLES IN RESIDENTIAL
NEIGHBORHOODS TO PROVIDE NON-CONFORMING USE
STATUS FOR USES ESTABLISHED PRIOR TO 1979;

EREAS, Ordinance No. 659 was adopted on(June 9, 1997, and prohibited the parking`o
s mi tractors, trucks, trailers, commercial vehicles and recreational vehicles in,residential
eighborhoods; and
\frHEREAS, the Ordinance did not address the situation where individuals may have a legal'non-
c nforming use involving the parking of these vehicles; and
\JHEREAS, it has become.necessary to amend Ordinance No. 659 to provide for the ability.to
p ove non-conforming use status for uses established prior to January 1979.
OW, THEREFORE, BE IT ORDAINED by the City Council of the City of Zephyrhills,
lorida, as follows:
ECTION 1. Section 71-28 of the Zephyrhills 'Code of Ordinances (Ordinance No. 659) is
ereby amended as follows: .
ection 71-28. Violations and Fine Schedule:
y violation of this ordinance shall constitute la class 5 violation, pursuant to the City o
ephyrhills Uniform Fine Schedule. Any use in violation of this ordinance which has been in
c ntinuous and 'open use since January 1, 1979 may apply for non-conforming use status for a
p riod of 90 .days from the, time the notice of violation was issued pursuant to Section
1 .01.04.02 of the Land Development Code, as amended.
ECTION 5. . Repealer. • ,
y ordinance, or part of any'ordinance, in conflict herewith is hereby repealed to the extent of
a iy conflict.
ECTION 6. Severability.
I is declared to be the intent of the City Council of the City of Zephyrhills, Florida, that if any
s ction, subsection, sentence, clause, or provision of this Ordinance shall be declared invalid, the
r- mainder-of this Ordinance shall be construed as_nothaving=contained said section, subsection,
s ntence, clause, or provision and shall not be affected by such holding.'
ECTION 7. Inclusion in Code.
he provisions of this Ordinance shall become and be made a part of the Code of Ordinances of
t e City of Zephyrhills, Florida. The sections of this Ordinance may be renumbered or re-
1 ttered and the word "ordinance" may be changed.to section , "article" or, such other
appropriate word or phrase in order to accomplish such.
S ICTION 8. Effective Date.
his Ordinance shall become effective on passage of the third reading and signing by the Mayor.
