AN ORDINANCE OF THE CITY OF ZEPHYRIULLS,
FLORIDA, REPEALING. ORDINANCE NO. 317 TO PROVIDE
A DESIGNATED TRUCK ROUTE FOR COMMERCIAL
VEHICLES; PROVIDING FOR DESIGNATION OF OFFICIAL N�
TRUCK . ROUTES THROUGH THE CITY LIMITS;

REAS, Ordinance No. 317 was adopted on May 11, 1981 in order to protect the public
h alth and safety by prohibiting truck-drivers having no specific destination point within the City '---
limits, from traveling through.the.City..utilizing;any,street other than S.R. 54, U.S. 301, or Fort o
K ng Road; andVVHE �'�
REAS, since that time, the City of Zephyrhills has grown and expanded and many
• c mmercial vehicles travel through the City often utilizing local roads through residential
neighborhoods with the City limits; and
WHEREAS,.despite repeated requests from the City, certain drivers of commercial vehicles
a cessing the certain areas within the City continue to traverse local streets thereby disturbing the
p aceful nature of neighborhood areas, endangering children playing in these areas, and b
d stroying the integrity of City roadways; and
WHEREAS, Section 316.006 (3), Florida Statutes, prohibits the City from erecting or
m�intaining any official traffic control devices at any locations so as to regulate the traffic on any
state road without prior approval from the Florida Department of Transportation(FDOT); and
'WHEREAS, the City of Zephyrhills has obtained prior written approval from the FDOT to erect s s
traffic control signage along U.S. 301/Hwy. 39, S.R. 54, U.S. 98 and C.R. 54 to provide and
designate an official truck route for commercial vehicles traveling through the City; and
EREAS, it has become necessary to revise Ordinance No..317 and to create a new ordinance
to include designated truck routes for commercial vehicles accessing destination points within
th City limits and for those traveling through the City of Zephyrhills to other destinations;
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Zephyrhills, Ati
F1h rida, as follows: ..
SECTION 1. Defmitions. The following words, terms and phrases, when used in this
or irance, shall have the meanings ascribed to them in this section, except where the context
cl arly indicates a different meaning:
Arterial Road means a roadway providing service which is relatively continuous and of i- o
relatively high traffic volume, long trip length, and high operating speed. In addition, every
U 'ted States or State of Florida numbered highway is an arterial road.
Collector Road means a roadway providing service which is of relatively moderate traffic
volume, moderate trip length, and moderate operating speed. Collector roads collect and
distribute traffic between local-roads-or arterial-roads..
Local Street or Road means a street that is designated to carry residential traffic between
co lector or other streets or highways and abutting properties.
Through traffic means traffic beginning at a point outside the City limits of the City of
Z hyrhills and having no point of destination or origin within the City limits. Through traffic
sh 11 not include commercial vehicles in the process of making a delivery to or pick-up from a
sp cific business or residence within the City.
Commercial Vehicle means every vehicle which is described as a truck, truck- tractor,
poi e-trailer,trailer or semi-trailer as described below.

Truck means any, motor vehicle (as defined by Florida State Statute), having a gross
vehicle weight of 10,000 pounds or more.
Truck-Tractor means a motor vehicle which has four (4) or more wheels and is designed
and equipped with a fifth wheel for the primary purpose of drawing a semi-trailer that is attached
or coupled thereto by means of such fifth wheel and which has no provision for carrying loads
independently. This definition is adopted from Section 320.01 (10), Florida Statutes. Any
subsequent amendments or changes to the definition of truck-tractor found in Section 321.10,
Florida Statutes, are hereby incorporated herein.
Semi-Trailer means every vehicle without motive power, other than a pole trailer, designed
for carrying property and being drawn by a motor vehicle and so constructed that some part of its
weight and that of its load rests upon or is carried by another vehicle.
Trailer means every vehicle without motive power, other than a pole trailer, designed for
carrying property and for being drawn by a motor vehicle and so constructed that no part of its
weight rests upon the towing vehicle.
Pole-Trailer means every vehicle without motive power designed to be drawn by another
vehicle and attached to the towing vehicle by means of a reach, or pole, or by being boomed or
otherwise secured to the towing vehicle, and ordinarily used for.transporting long or irregularly
shaped loads such as poles, pipes or structural members and capable, generally, of sustaining
themselves as beams between the supporting connections.
Destination Point means the location on a given street where any portion of a commercial
vehicle's cargo is to be loaded or unloaded, or the service is to be provided (as in construction,
public utility or tree removal vehicles, for instance).
SECTION 2. Designated Official Truck Routes.
1. The following arterial and collector roads are hereby designated as official truck routes
within the City of Zephyrhills, Florida:
a. U.S.301.,within the City limits.
b. Fort King Road, within the City limits.
c. S.R. 54, west from its intersection with U.S. 301, within the City limits.
d. C.R. 54E, within the City limits.
e. Eiland Blvd.,within the City limits.
f. Chancey Road, within the City limits.
g. 6th Avenue from its intersection with Chancey Road to its intersection with South
Avenue.
h. South Avenue from its intersection with 6th Avenue to its intersection with Airport
Road.
i. C.R. 39,within the City limits.
j. Upon its completion, 20th Street between Alston Avenue and Chancey Road.
k. Upon completion of 20th Street (as defined in subsection "j" above), the truck
routes described in subsections "m"and"n"below are hereby repealed.
1. Kossik Road from its intersection with U.S. 301 to its intersection with Greenslope
Drive.
m. Until 20th Street (as defined in subsection "j" above) is completed, the South
Avenue truck route is extended west to its intersection with 20th Street.
n. Until 20th Street (as defined in subsection "j" above) is completed, the 20th Street
truck route exists between its intersections with South Avenue and Alston Avenue.
SECTION 3. Commercial Vehicles: Prohibitions,Exceptions and Exemptions.
1. Prohibition: It shall be unlawful for any person to operate any commercial vehicle upon
any street within the City of Zephyrhills except those streets designated herein as s official
truck routes.

2. Exceptions:
a. Operation on Street of Destination Point. The operation of commercial vehicle
over and along any street where and when necessary to the conduct of business
including pickup or delivery, at a destination point, provided designated officia
truck routes'are used until reaching the intersection nearest the destination point
except as provided in subsection (b) hereof. If-additional pickups or deliveries a
multiple destination points within the City are required, the vehicle doesn't need t
return to the truck routes after each individual delivery but shall return to the true
route nearest to the final destination point upon completion of business.
b. Detours. The operation of commercial vehicles upon any officially establishe
detour in any such case in which such vehicles could be operated over and alon
the street for which the detour is established, (such as a truck route or a destinatio
point street).
3. Exemptions:
a. Municipal Vehicles — Due to the nature of their work and the need to hay
unhindered access to all City streets, municipally-owned or leased vehicles whic
would otherwise be regulated by this ordinance are hereby specifically exempte
therefrom. For the sake of clarification this shall include, but is not necessari
limited to the following municipal vehicles: Fire Department, Police Department
Public Works Department, Utilities Department and vehicles of any agent thereof
provided said agent's vehicles are then engaged in official municipal business.
b. Emergency Vehicles—Any and all emergency vehicles not covered in Subsectio
(a) above.
c. Recreational Vehicles—Those motor vehicles and trailers commonly referred to a
"recreational vehicles" or"R.V's" and which would otherwise be regulated by thi
ordinance. For the sake of clarification this shall include, but is not necessari
limited to the following vehicles: motor homes, campers, boat/traile
combinations.
SECTION 4. Enforcement and Penalties.
Violations of this Ordinance shall be deemed a City Ordinance violation-and shall be punishabl
pursuant to the City's Uniform Fine and Citation Ordinance and fee schedule.
ECTION 5. Repealer.
ll ordinances, including Ordinance No. 317, or parts of ordinances in conflict herewith, ar
hereby repealed.
SECTION 6. Severability.
I is declared to be the intent of the City Council of the City of Zephyrhills, Florida, that if an
s ction, subsection, sentence, clause, or provision of this Ordinance shall be declared invalid, th
r�mainder of this Ordinance shall be construed as not having contained said section, subsection
sentence, clause, or provision and shall not be affected by such holding.
SECTION 7. Effective Date.
his Ordinance shall take effect upon passage on the third reading and signing by the Mayor.
