(S&R PROPERTY) REAS, S & R Development, L.L.C., the owners of lands hereinafter described in Section 2 blow, did petition on the 12th day of January, 2004 for rezoning of said land; and HEREAS, the City Council approved the annexation of said land within the corporate limits of t e City on December 13, 2004; and EREAS, the City Council approved the future land use map amendment of said land to R sidential Suburban on December 13, 2004; and V'HEREAS, due public notice of hearing on the proposed rezoning was given by the City C uncil on November 11 and November 18, 2004 as required by the Zephyrhills Land D velopment Code, as amended, and Chapters 163 and 166, Florida Statutes; and V,HEREAS, the Planning Commission, sitting as the Local Planning Agency did hold a public haring on October 25, 2004 to consider said proposed rezoning; and WHEREAS, the City Council has been given authority by the State of Florida, pursuant to C1iapters 166 and 163, Florida Statutes,to rezone the property within the City limits upon receipt ofiwritten consent of the land owner, together with approval of the City Council of said rezoning d ly expressed by Ordinance; and H WEREAS, the City Council has determined that the PUD, Planned Unit Development, zoning category would be appropriate, would promote the general welfare and encourage proper development within the City; N W THEREFORE BE IT ENACTED AND.ORDAINED BY THE CITY COUNCIL OF Z PHRYHILLS, FLORIDA AS FOLLOWS: Se tion 1: The above Whereas clauses are hereby adopted and incorporated herein. Se Lion 2: The City Council for the City of Zephyrhills has determined that the PUD, Pl4nned Unit Development, zoning category would promote the general welfare and encourage pr per development within the City, and that the following described lands, lying and being si ated in Pasco County, to wit: Se Legal Description attached hereto and incorporated by reference as Exhibit"A"; Pr petty subject to PUD zoning comprises approximately 281.81 acres. Development shall be in accordance with the application, plans and, information su mitted by the developer unless otherwise stipulated or modified herein. 2. All wetlands and adjoining buffer, conservation/preservation areas and wildlife habitat/corridor areas shall be placed under a perpetual conservation easement in favor of the Record and Return to: City Clerk's Office 5335 8th Street Zephyrhills, FL 33542 OR BK 6217 PG 10 2 of 5 City of Zephyrhills. Prior to record plat submittal, the developer shall submit one (1) copy of the executed and recorded conservation easement in a form acceptable to the City Attorney, to the Zephyrhills Planning Director. All conservation easement areas shall be depicted as an overlay on the Final Development Plan and Final Plat. 3. The developer shall create a mandatory homeowners' association in the form of a non- profit corporation registered with the Florida Secretary of State. The developer shall convey in fee simple to the association for ownership and maintenance, all open space, drainage areas, common areas, landscape areas, wetland areas, buffer areas, preservation/conservation areas, and other special purpose areas unless the said area(s) are required to be dedicated to another governmental entity. Recreation areas and neighborhood parks shall be conveyed to the association. Prior to approval of the final plat, the homeowners' association, documents, including Articles of Incorporation with proof of filing with the Secretary of State, restrictive covenants, and all exhibits, shall be submitted to the Planning Director for review along with copies of instruments to be used to convey in fee simple the above-mentioned areas to said association. 4. In addition to these PUD conditions of approval, the developer shall comply with all City of Zephyrhills ordinances including all impact fee ordinances. 5. In the event ordinances/resolutions are subsequently adopted by the City Council including, but not limited to, utilities, public safety, impact fee or other, the developer shall be required to comply with same except if such ordinances/resolutions materially and adversely change any conditions of the approval granted herein. 6. Streets shall be public and shall be constructed to City standards. Any private streets should be dedicated and maintained by an appropriate entity other than the City of Zephyrhills. All streets, including associated stormwater inlets, sanitary sewer manhole rims, and the top of the lift station wet well as shown on the final development plan shall be constructed at or above 100 year flood elevation. 7. The developer has submitted a traffic study which was reviewed and approved by staff and the site plan review committee. Prior to approval of the final plat, the developer shall bond or construct all transportation improvements identified herein. The developer shall construct an eastbound left-turn lane and a west bound right-turn lane at the intersection of Eiland Blvd. and the project entrance. The Developer shall obtain a right-of-way use permit from Pasco County prior to connection to Eiland Boulevard. 8. The traffic study submitted by the developer assumes 605 single family detached units. Any development of land:use(s) that generate greater traffic impacts than those assumed shall require an updated traffic study utilizing a methodology approved by the City of Zephyrhills. 9. Prior to approval of the final plat, the developer shall bond or construct any off-site improvements identified in condition No. 7. 10. Developer shall provide a connection point for an inter-neighborhood street connection between Village Five and the proposed future phase of the Cottages at Silver Oaks to the east, as well as, an inter-neighborhood connection to the proposed Chapel Creek residential development to the west. 11. Developer shall convey, at no cost to the City, 130 feet of right-of-way for construction of a new east-west collector road to become an extension of Sunshine Road. The proposed location of the right-of-way is shown on the Preliminary Development Plan. The Developer shall not be entitled to impact fee credits for right-of-way conveyance. 12. Stormwater management and drainage plans, including for the open basin portion of the development, shall be designed in accordance with Southwest Florida Water Management District (SWFWMD) requirements for closed drainage basins. The total post-development volume leaving the site shall be no more than the total pre-development volume leaving the site for the design of a 100-year storm. Maintenance of pre-development off-site low flow may be required in hydrologically sensitive areas. OR BK 6217 PG 11 3 of 5 3. Subject to the City's approval of longer cul-de-sacs, developer will eliminate the wetland i pact on two lots between Villages 3 and 5 and will expand the proposed pond system to creat additional storage volume in that area. 14. Developer will submit a lot grading plan to the City prior to the final approval of it construction plans. 15. Developer will identify additional upland areas that can be utilized for additional storage Up for to the final approval of its construction plans. If necessary, the Developer will eliminate ups to five (5) additional lots within the development to increase stormwater retention above and beyond the 100 year volume required by Southwest Florida Water Management District (SWFMD). This additional retention is subject to approval by the District based upon their afialysis of the,downstream hydrologic impacts. 16. Pasco County will provide water and wastewater services to the project. The Developer m ill enter into a separate Utility Service Agreement with the County for water and wastewater treatment and service to the S & R Property subsequent to obtaining the Comprehensive Plan endment and re-zoning approval. 1 . Development shall be in accordance with the Preliminary Development Plan for S lverado submitted to the City on September 20, 2004, such plan dated July 27, 2004 and last r vised on September 13, 2004. The approved uses and conditions of approval are as follows: a. Maximum 555 single-family lots (actual density and lot layout may be modified based on fmal engineering design and ultimate location of proposed east/west road corridor). b. Typical Minimum Lot Sizes shall be: 50 ft. x 110 ft. 60ft. x110ft. 65 ft. x 120 ft. c. Setbacks: Front—20 ft. Side-7.5 ft. Rear— 15 ft. d. Developer shall provide a community recreation center, including a swimming pool, restroom facilities, picnic area, multi-purpose sports field and playground equipment. Developer shall also provide small neighborhood parks within certain villages as generally shown on the Preliminary Development Plan. e. Front setbacks shall be staggered not less than 2 ft. on adjacent lots. f. In order to avoid repetitive front elevations and exterior colors, homes with the same front elevation or exterior color shall not be located next to each other or directly across the street from each other. g. Overhead garage doors shall be permitted on the front of each home. h. The lots in closest proximity to the northern,boundary of the property shall be minimum 65 ft. x 120 ft. i. A uniform mailbox and post design shall be provided throughout the community. j. A Street Tree Plan shall be included in the Final Development Plan. k. Landscape and/or fence buffers will be shown on the Final Development Plan. 1. A minimum of 2 trees, including existing trees, shall be provided on each lot. m. Tree preservation shall be shown on Final Development Plan. OR BK 6217 PG 12 4 of 5 n. Entry features and signage shall be shown on Final Development Plan. o. Street lights shall be operated and maintained by a street lighting district or homeowners association. p. Decorative post-top street lights shall be provided within residential villages. q. Pedestrian access trails to the Nature Park and other passive recreation areas shall be shown on the Final Development Plan. r. An 8 ft. wide bike/hike trail shall be provided along one side of the central, north- south collector road, and a 5 ft. wide sidewalk on the other side. 18. Recreation site development standards shall be in accordance with the City of Zephyrhills Land Development Code and the Park Impact Fee Ordinance as amended. 19. Unless required elsewhere within the conditions of approval, all conveyances to the homeowners' association required pursuant to this rezoning shall occur prior to the issuance of the first certificate of occupancy in a form acceptable to the City Attorney, and excluding any homeowners' association restrictions or encumbrances shall be free and clear of all liens and encumbrances. 20. The re-zoning request and preliminary plans have been reviewed by staff and deemed consistent with the Land Development Code, the Comprehensive Plan and the levels of service requirements and a compliance certificate will be issued by the City of Zephyrhills upon final approval of this ordinance. Section 3: This ordinance shall supersede all ordinances or parts of ordinances in conflict herewith. Section 4: That if any section, sentence, clause or phrase of this ordinance is held to be invalid of unconstitutional by a court of competent jurisdiction, then said holding shall in no way affect the validity of the remaining portions of this ordinance. Section 5: This rezoning amendment shall take effect as provided in the City Charter and Chapter°1`63.,Florida Statutes ?
