JED PITTMAN PASC0 COUNTY LERK 01/20/05 11 :3�3}am 1 of 3 OR BK 6 19 f PO 8 WHEREAS,-.Ordinance No. 775-01 was adopted on March 26..2001, and created the Airport Authority; and WHEREAS, the Authority was created to provide for recommendation to the City Council on planning and policy making information relating to the day to day operation and management of tl�e municipal airport; and VTHEREAS, it has become necessary to amend Ordinance No. 775-01 to provide for a pointment of additional members. NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Zephyrhills, Florida, as follows: SECTION 1. Section 5 of Ordinance No. 775-01, Authority; Creation and Purpose, is hereby amended as follows: Tiere is hereby created a body politic and corporate to be known as the "Zephyrhills Municipal Airport Authority". The exercise by the Authority of the powers conferred upon it by this Ordinance will be deemed to be for an essential and proper public purpose. The Zephyrhills unicipal Airport authority is hereby established for the purposes of advising City Council on issues related to planning, development and policy for the Zephyrhills Municipal Airport authority. The Authority is charged with the responsibility of reviewing the existing Airport master Plan and the annual Airport budget and Capital Purchases budget, and making r:Ld ommendations to City council, recommending appropriate planning and development policies aid reviewing specified development proposals for conformance with said Plan. CTION 2. Section 6 of Ordinance No. 775-01, Membership; Terms of Office; Officers; Quorum; Meetings; emoval, is hereby amended as follows: Membership; Terms of Office; Officers; Quorum; Meetings; Removal: 1 The Authority shall consist of a total of seven (7) members, five (5)members to be appointed by the City Council. Each Council member shall nominate a -candidate for the Airport Authority whose nomination must be approved by a majority of the Council. In addition, one other member shall be nominated by the Council to the Airport Authority, and one member shall be nominated by the Mayor. The nomination of the additional members must be approved by a majority of the City Council. 2 The terms of office for the membership of the Authority shall be staggered. The term o office for each member shall be two (2) years from the date of appointment. The initial term of office for the two new members shall be for a period of one year. Thereafter, the term o office for these additional members shall be two (2)years from the date of appointment. A chairperson, vice-chairperson, and secretary shall be chosen by and from the Authority membership. The term of office for the chairperson, vice-chairperson, and secretary shall be one (1) year, and no member shall hold the same office for more than two (2) consecutive terms. 4. A quorum shall consist of four (4) members, but the affirmative vote of not less than four (4) members shall be necessary to take any action except to adjourn. 5. The Authority shall meet at least once each month at such times and places within the City as shall be determined by the Authority. The agenda for the June meeting shall include the review of annual duties of the Authority and election of officers. 6. Any member maybe removed, by the City Council, but only_for grounds, -constituting misfeasance, malfeasance or nonfeasance in office, or upon conviction of any `crime. The unexcused failure to attend three (3);consecutive regular meetings of the Authority shall be deemed nonfeasance, without limiting the meaning of that term. The Chairman of the Airport Authority shall have the authority to approve or excuse absences. 7. Vacancies in office shall be filled by the City council for the balance of the term, not later than thirty(30) days after notice of the vacancy has been given to the City Council. 8. No officer or employee of the City of Zephyrhills; officer or owner of a flight club based at the airport; officer, owner or employee of any commercial business based at the airport, or flight school with aircraft based at the airport, shall be eligible for membership in the Authority. No member of said Authority shall be interested in the profits.or iemoluments of any contract, work, sale to or service for the airport, and any such contract in which a member is or may be interested, shall be declared void by the City Council of the City of Zephyrhills. SECTION 3. Seetion 7 6f Ordinance No. 775-01,Powers and Duties, is fiereby amended as foflows � The Authority shall recommend to City Council on issues related to planning, development, policy making, capital improvement projects, and budgeting for the Zephyrhills Municipal Airport. The Authority shall have the authority to approve all expenditures previously budgeted by the City Council. The Authority shall have the following specific powers and duties: (11) To fix and revise from time to time and to collect rates, fees, and other charges for the use of or for the service and facilities furnished by or at the airport, subject to approval of City Council. These duties, including fees and rates, shall be reviewed and updated, if appropriate, at the annual June meeting. SECTION 4. Section 9 of Ordinance No. 775-01, Airport Manager/Airport Personnel, is hereby amended as follows: The airport manager shall be appointed by the City Manager and shall be an employee of the City of Zephyrhills. The decision to employ or terminate-the employment of the airport manager shall be the responsibility of the city manager. The Chairman of the Airport Authority shall have the right to contribute to the annual review of the airport manager. The airport manager shall be charged with the responsibility of the day to day operation and management,of the airport and shall have all of the powers and duties provided by Chapter 91 of the Code.of the City of Zephyrhills, as same now exists or may be amended from time to time, as well as all powers and duties delegated to the airport manager by the city manager. All other personnel employed to work at the airport shall be city employees and the decision to employ or terminate them shall be the responsibility of the airport manager. OR BK 6197 PG 89 SECTION 5. Repealer. 3 of 3 Any ordinance or part of any ordinance, in conflict herewith is hereby repealed to the extent o any conflict. SECTION 6. Severability. It is declared to be the intent of the City Council of the City of Zephyrhills, Florida, that if an section, subsection, sentence, clause, or provision of this Ordinance shall be declared invalid, the remainder of this Ordinance shall be construed as not having contained said section, subsection, sentence, clause, or provision and shall not be affected by such holding. SECTION 7. Inclusion in Code. The provisions of this Ordinance shall become and be made a part of the Code of Ordinances o the City of Zephyrhills, Florida. The sections of this Ordinance may be renumbered or relettered and the word "ordinance" may be changed to "section", "article" or such other appropriate word or phrase in order to accomplish such. SECTION 8. Effective Date. This Ordinance,shall become effective upon passage on the second reading and signing by th ffayor.
